Resumo: O presente artigo pretende ser um duplo movimento de reflexão sobre as categorias utilizadas para tratar da história do constitucionalismo moderno. Primeiramente, apresentará a categoria de “Atlântico Negro” e suas respectivas contribuições para uma “reperiodização” da modernidade, especificamente quanto aos movimentos sociais de reivindicação de direitos. Em seguida toma um evento particular desse Atlântico Negro, a Revolução Haitiana, como prisma hermenêutico e metodológico para pensar as disputas constitucionais. Busca-se, desse modo, adotar o ponto de vista de uma filosofia da história que lide, de maneira integrada, com a modernidade e o colonialismo. Por fim, tecerá breves comentários sobre como esse duplo movimento poderá contribuir para a reflexão sobre o direito constitucional contemporâneo. Abstract: The present paper aims to be a double movement of reflection about the history of modern constitutionalism. Firstly, it introduces the “Black Atlantic” category and its respective contributions to perform a “re-periodization” of modernity, specifically in relation to social movements of human rights. Then, it takes one particular event of this Black Atlantic, the Haitian Revolution, to be a methodological and hermeneutical prism to think the constitutional struggles. Thereby, the paper intends to embrace a point of view of the philosophy of history that deals with modernity and colonialism in an integrated manner. Lastly, it shows how this double displacement can contribute to the contemporary constitutional thought.
O texto tematiza as relações entre discurso jurídico e racismo institucional no Brasil. Trata, especificamente, da violência silenciosa contida na forma como o próprio discurso jurídico qualifica (ou não qualifica) as violências das formas de gestão dos espaços urbanos e dos espaços de encarceramento. Empenha-se em compreender o papel dos juristas na reprodução dessa violência cotidiana. Para exemplificar, propõe a interpretação dos textos de Eugênio Raúl Zaffaroni sobre as relações entre a violência institucional e o papel de uma dogmática penal crítica para conter a seletividade da agência policial. Desde o Realismo Marginal (e de sua crítica), sugere que a branquidade é essencial para entender os limites das melhores propostas de reconstrução da dogmática, pois a formação tradicional acadêmica provoca efeitos concretos de violência sobre os corpos negros. Logo, a crítica à dogmática penal necessita ser situada para além da crítica de suas promessas não realizadas. O processo de racialização dos saberes e das práticas jurídicas deve ser compreendido nas articulações entre o dito e o não-dito. Logo, deve incluir os não-ditos dessas promessas de racionalização da violência institucional, e nominar os que ficaram fora do pacto da branquidade de garantia de direitos.
This article aims to understand the emergence of the academic field of critical studies on racism, and its intersectionality with gender and class in the last three decades, in Brazilian criminology. It identifies the core elements of a specific grammar on epistemological perspectives, academic agendas, and political solutions. At the same time, it points to the participation of new subjects, subjectivities, and relations of academic production and dissemination. It also explores the impact of the post-Durban Conference Era (2001) – the crisis of the ideology of racial democracy – on scientific production on inequality and the negative effects of the criminal justice system. It proposes an explanation for the changes in academic production stemming from the transformations of Brazilian public universities.
We claim the importance of this epistemological and methodological renewal to address the inequalities of the criminal justice system: the incorporation of new concepts and perspectives such as genocide, whiteness, epistemicide, intersectionality, and necropolitics; the emphasis on the production of Black intellectuals, historically ignored by the academy, who thematised dimensions of racial violence from their experience and political struggle; the emergence of new research networks throughout Brazil and new profiles of researchers, an effect of racial diversity resulting from affirmative action in higher education; more dialogue between academic research and the demands of social movements; new social movements that actively used the media to confront police and prison violence.
