El impacto generalizado de la violencia criminal en América Latina la ha llevado a ser catalogada como la región más peligrosa del mundo por la Oficina de Naciones Unidas contra la Droga y el Delito. Esta situación, sumado a la inefectividad de las políticas ejecutadas hasta ahora para mitigarlo ha generado un intenso debate acerca de cómo algunas herramientas clásicas de resolución de conflictos como la mediación podría explorarse a objeto de contener la violencia asociada a cárteles, milicias y pandillas. Sin embargo, ¿cuáles son los principales riesgos de mediar con grupos criminales? Este artículo de investigación tiene como objetivo responder a dicha interrogante empleando como caso de estudio la ciudad de Medellín. En 2003, la capital antioqueña experimentó una dramática caída en los homicidios gracias a la hegemonía de alias Don Berna sobre los actores armados operativos en la ciudad y posterior desmovilización de su grupo paramilitar Bloque Cacique Nutibara, periodo conocido localmente como Donbernabilidad. De esa manera, a partir del caso colombiano, este trabajo analiza, bajo un enfoque cualitativo, las principales limitaciones que enfrentan los gobiernos al mediar con actores criminales para reducir los niveles de letalidad, normalmente a cambio de bene cios judiciales.
Uno de los efectos más latentes ocasionados por la estrategia de confrontación abierta al crimen organizado, mantenida en México desde el sexenio pasado, ha sido el traslado de los principales grupos criminales hacia el Triángulo Norte de América Central. A partir de ese escenario, el presente artículo de investigación tiene como objetivo responder la siguiente pregunta: ¿Por qué aquel territorio se ha transformado en el nuevo centro de operaciones para los principales carteles mexicanos? Para tal efecto, se analizan, bajo un enfoque cualitativo, los principales factores que han facilitado la expansión del crimen organizado mexicano en esa área geográfica. Luego, se abordan las conexiones y dinámicas entre los carteles mexicanos y otras organizaciones criminales operativas en esa subregión como los transportistas y maras. Finalmente, se evalúa la viabilidad de una alianza estratégica entre dos actores con mayor preponderancia en la escena criminal de aquella zona: Los Zetas y Mara Salvatrucha. El trabajo concluye que, por su ubicación geográfica, sus fronteras porosas, su debilidad institucional y creciente sofisticación de sus grupos criminales locales −transportistas− y maras, el Triángulo Norte de Centroamérica ofrece amplias oportunidades para la expansión del narcotráfico mexicano.
La violencia asociada a la Guerra contra el narcotráfico ha acaparado la atención de la comunidad internacional durante los últimos años. En septiembre de 2014, la Federación Internacional de Derechos Humanos presentó ante la Fiscalía de la Corte Penal Internacional una solicitud para investigar, de manera complementaria, la presunta comisión de crímenes contra la humanidad en México durante el mandato de Felipe Calderón (2006-2012). Ante ese escenario, este trabajo estudia la pertinencia de clasificar a la Guerra contra el narcotráfico como conflicto armado interno bajo los estándares de la legislación internacional. Luego, se analiza la hipotética aplicación del tipo penal “crímenes contra la humanidad” al periodo señalado previamente. Por último, se detallan los principales inconvenientes de utilizar esa figura en el caso mexicano..
Producto de la complejización y expansión de la violencia criminal durante la Guerra contra el narcotráfico, ha surgido un debate sobre la necesidad de resignificar el concepto insurgencia para aplicarlo al contexto mexicano, particularmente a Los Caballeros Templarios, un grupo criminal cuyo modus operandi se asemeja al utilizado por rebeldes. Sin embargo, ¿Los Caballeros Templarios representan un nuevo tipo de insurrección? Este trabajo pretende responder dicha interrogante, analizando y contrastando el comportamiento de ese cartel con los principales elementos teóricos de la insurrección: motivación, apoyo popular, uso de la violencia; y sujeto de mediación.
