O presente trabalho exibe os dados referentes à regulamentação da obrigatoriedade do ensino da história da cultura afro e indígena em todos os níveis de ensino, sendo esta embasada na Lei nº 11.645/2008, a qual trata das políticas públicas educacionais para estas populações. Diante disso, objetivamos analisar de que modo à lei afro-indígena é executada no município de Itapetinga/BA, e quais as possíveis alterações a mesma provoca no processo de construção da identidade cultural. O percurso metodológico adotado para obter tais fins foi a pesquisa de campo com abordagem qualitativa. O instrumento de coleta de dados utilizando foi a entrevista (semiestruturada). Formam a amostra desta pesquisa: coordenador e professores do ensino fundamental I, II e ensino médio de três escolas do município. Para contribuição na elaboração do trabalho foram utilizados autores, como: Triviños (1987), Godoy (1995); Martins (1994), Gonsalves (2001). A partir do estudo realizado concluímos que a lei afro-indígena aplicada no ensino fundamental I é trabalhada de forma transversal; no ensino fundamental II é aplicada como uma disciplina obrigatória com carga horária de 40h semanais e no ensino médio, é aplicada de forma interdisciplinar. Percebemos ainda que esta política pública não é implementada em sua integralidade nas três escolas pesquisadas, sendo esta aplicada de formas diferentes, notamos que existem lacunas na aplicação desta lei, porém quando executada de forma séria temos avanços no modo em que os alunos compreendam a cultura afro e indígena para a formação da identidade cultural.
