Bien qu’étranger au droit du travail, le principe de précaution s’invite désormais dans la gestion des risques professionnels émergents. Extraits d’une série de monographies, l’article décrit des modes d’usages du droit mobilisés par des salariés et des directions d’entreprises qui articulent précisément précaution et prévention à l’égard d’applications technologiques liées aux nanomatériaux. Nous montrons un mouvement de convergence de ces deux droits au service non seulement de l’information sur les risques, mais aussi de leur gestion. Alors que la place de la précaution en droit du travail est une question encore peu considérée du point de vue juridique ou sociologique, l’article souligne l’interdépendance des droits du travail et de l’environnement dans la prévention des risques professionnels nouveaux.
Cet article, appuyé sur une enquête ethnographique, rend compte du travail d’encadrement dans le secteur marchand de l’aide à domicile. Interrogeant le travail d’articulation des managers de proximité, il montre comment ce personnel œuvre pour répondre aux différentes tensions qui traversent un milieu caractérisé par une forte demande économique, un haut taux de rotation du personnel et une sinistralité importante. Pris dans certaines logiques contradictoires et injonctions paradoxales, ce personnel encadrant sort régulièrement du cadre. Le cas du système de reconnaissance et de rémunération variable permet d’illustrer cette activité et ses tensions.
