Las resoluciones de la Suprema Corte de Justicia de la Nación sobre el alcance del principio de relatividad y la protección ante la inacción de las autoridades administrativas han aumentado el margen de incidencia de los jueces constitucionales en las políticas públicas. Este papel de los jueces es relevante para los estudios de derecho y de políticas públicas.Este artículo identifica y analiza tres casos de jueces federales que ordenan medidas de protección a la salud, el suministro de agua potable y un ingreso mínimo vital de marzo a agosto de 2020. Hallamos que a pesar de los criterios de la Suprema Corte, posiblemente los jueces no participan en el diseño de políticas públicas durante la pandemia y su papel se reduce a la reafirmación de valores sociales.
La covid-19, en cuanto evento que interrumpió las actividades económicas en el mundo, afectó las agendas de las políticas gubernamentales. En Latinoamérica, la mayor parte de las respuestas fueron centralizadas por los Gobiernos nacionales, sin embargo, en México, las 32 entidades federativas desarrollaron políticas económicas propias frente a la pandemia. El caso mexicano nos permite analizar recientes hipótesis de los estudios comparados sobre esta temática en cuyas propuestas se plantea que el tamaño de la población y la escala y la estructura socioeconómica de las administraciones pueden ser factores que explican el alcance y la diversidad de las agendas locales. Se emplea una metodología cuantitativa con base en la estimación del índice de entropía de Shannon y la realización de pruebas no paramétricas. Contrario a lo esperado, encontramos que el alcance y la diversidad de las respuestas no se relaciona significativamente con los factores propuestos en la literatura. Al menos para el caso de la covid-19 en el corto plazo, el tamaño y la diversidad de las agendas locales en México parecen basarse en factores institucionales como el procesamiento de la información conforme a la racionalidad limitada, las soluciones incrementales y el etiquetado funcional de los Gobiernos locales. Así, la variedad de las agendas se sustenta en los intereses directos de las comunidades.
A partir de la pandemia de Covid-19 y la generalización de las clases en línea, uno de los retos más importantes en la enseñanza jurídica fue trasladar la experiencia de las actividades presenciales al entorno digital. Esto es un desafío especialmente en la materia de Derecho y Economía, la cual utiliza prácticas de aprendizaje basadas en teorías de juegos y simulaciones, donde los participantes interactúan entre sí para alcanzar ciertos objetivos. Una de las actividades que sirve para analizar las dificultades de alcanzar acuerdos y mantenerlos es el “juego del bien público”, ya que muestra a los participantes los costos de transacción que pueden complicar la celebración de contratos (Coase 1992). En el juego, los estudiantes perciben las dificultades de contribuir a un bien público mediante la negociación y celebración de acuerdos de manera presencial. Por ello, la actividad se torna compleja al implementarse en una clase en línea. No obstante, utilizando algunas ventajas de la plataforma Zoom, fue posible mejorar de manera novedosa algunos aspectos del juego del bien público, como lograr un desarrollo paralelo de varias sesiones de la actividad y una comunicación eficiente de los resultados durante la misma sesión. El presente artículo expone como el uso de la tecnología facilitó el aprendizaje sobre las dificultades de alcanzar acuerdos y de su cumplimiento.
The quarantine and stay-at-home measures implemented by most governments significantly impacted the volume and distribution of crime, and already, a body of literature exists that focuses on the effects of lockdown on crime. However, the effects of lockdown on firearm violence have yet to be studied. Within this context, this study analyzes reports of gunshots in Mexico City registered on Twitter from October 2018 to 2019 (pre-COVID-19) and from October 2019 to 2020 (during COVID-19), using a combination of spatial (nearest neighbor ratio, Ripley’s K function and kernel estimation) and non-spatial (Fisher’s exact test) methods. The results indicate a spatial concentration of gunshot reports in Mexico City and a reduction in frequency of reports during the pandemic. While they show no change in the overall concentration of gunshots during lockdown, they do indicate an expansion in the patterns of spatial intensity (moving from the west to the center of the city). One possible explanation is the capacity of possible victims of firearm crimes in certain municipalities to comply with lockdown measures and thus avoid exposure to such crimes.
