One of the form of applying the value of democratic in Indonesia is accommodate by the regulation of community organization which is concretely regulated in the provisions of article 28 E Paragraph 3 of the 1945 constitution also in the provisions of law number 39 of 1999 on Human Rights. The existence of community organizations does have a great constribution in the implementation of the state, but on the other hand the existence of people raises the pro and contra. The enecment of government regulation number 59 on community organization established by foreign citizens makes the community more worried if the exixtance of community organizations affect the sovereignty of NKRI because they have different ideology with Indonesia. Based on this, it should be discussed about the organizations in Indonesia. The position of foreign social organizatios in Indonesia is reviwed from the government regulation number 59 of 2016 on community organizations established by foreign citizens and the influence of basic organizations for the sovereignty of NKRI. To answer that question, qualitative method is used as a means to answer the problem by conducting of normative juridical approach which is done by reviewing the law and the literature. Based on this study, it is concluded that the existence of foreign social organizatios in Indonesia in line with democracy and human right but also politically can treaten NKRI.
<p class="Default">Sejak berlakunya Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah, penerapan era desentralisasi pun menjadikan daerah-daerah memiliki otonomi yang seluas-luasnya untuk mengatur urusan rumah tangganya sendiri sesuai dengan kebutuhan dan potensi daerah masing-masing. Untuk mewujudkan pembangunan desa yang berkualitas dalam upaya meningkatkan kualitas hidup manusia, serta penanggulangan kemiskinan dapat dilakukan dengan pemberdayaan salah satu unit ekonomi yang ada di Nagari, yaitu Badan Usaha Milik Nagari (BUMNag, atau didaerah lain disebut BUMDes). Penelitian ini bertujuan untuk menggambarkan dan memahami <em>pertama</em>, Bagaimana mekanisme pendirian Badan Usaha Milik Nagari (BUMNag) di Nagari Cupak, kecamatan Gunung Talang Kabupaten Solok <em>kedua</em>, Bagaimakah peranan Badan Usaha Milik Nagari (BUMNag) dalam peningkatan kesejahteran masyarakat Nagari Cupak Kecamatan Gunug Talang Kabupaten Solok.Penelitian ini memakai metode penelitian yuridis empiris untuk melihat bagaimana mekanisme pendirian BUMnag di Nagari Cupak kecamatan Gunung Talang Kabupaten Solok. Berdasarkan hasil penelitian ini ditemukan Pertama, mekanisme pendirian Badan Usaha Milik Nagari (BUMNag) yang bernama Badan Usaha Milik Nagari Usali di Nagari Cupak Kecamatan Gunung Talang Kabupaten Solok dibentuk melalui musyawarah Nagari dengan dihadiri tokoh-tokoh masyarakat. BUMNag Usali Cupak telah berperan dalam pemberdayaan masyarakat dan peningkatan kualitas perokonomian di Nagari Cupak melalui unit usaha pertama Konveksi, keduA Agen BNI/PPOB BNI dan yang ketiga adalah Tabungan Bajapuik atau simpan pinjam. Kegiatan yang ini yang telah memberikan dampak terhadap peningkatan ekonomi masyarakat.</p>
There is a legal vacuum regarding determining loan interest rates in Article 17 paragraph (1) POJK No. 77/01/2016 concerning Information Technology-Based Lending and Borrowing Services (ITBLBS). With this legal vacuum, O.J.K. has given the authority to AFPI to self-regulate the determination of loan interest rates at ITBLBS. With authority as an S.R.O. ( Self Regulating Organization ) institution owned by the Indonesian Joint Funding Fintech Association (IJFFA). The method used is normative legal research by analyzing primary, secondary, and tertiary legal materials related to the research title. The interest rate in the code of conduct that IFFFA determines as the principle of operation in ITBLBS directly affects the inflation rate. However, Bank Indonesia, as the institution authorized and responsible for targeting inflation in terms of controlling interest rates circulating in the fintech market, is not given any authority based on Article 17 POJK N0. 77 of 2016. This is in contrast to the inflation targeting objective, which is the authority of B.I. It can be concluded that the determination of interest rates in the existing ITBLBS is normatively out of sync between the objectives of the legislation and the objectives of the IJFFA code of conduct.
