Environmental criminal law in French Polynesia suffers from the antagonism existing between the autonomous power of the Community regarding environmental protection and the criminal competence of the State. Though Polynesia may participate in the exercise of State competences in penal matters and penal process, the statutory conditions limiting this power prevent the adoption and implementation of a penal protection adequate enough to the local particular situations and efficient enough to stop the damage to an environment as exceptional as it is fragile.
