Keadilan lingkungan berdasarkan taksonomi keadilan dibagi dalam empat katagori (yaitu, keadilan lingkungan sebagai keadilan distributif, keadilan lingkungan sebagai keadilan korektif, keadilan lingkungan sebagai keadilan prosedural dan keadilan lingkungan sebagai keadilan sosial. Dalam pembahasan perumusan permasalah ini, keadilan lingkungan sebagai keadilan sosial. Penulis mengartikan keadilan lingkungan sosial digunakan berbarengan untuk memperkuat pemahaman mengenai keadilan lingkungan sebagai sebuah keadilan sosial.
The government needs to restructure the institutions that are responsible for prosecution and the calculation of appropriate compensation to avoid the time-consuming and complicated process of calculating losses and need to establish a loss adjuster agency. The Coordinating Ministry for Maritime Affairs is expected to be the coordinator, coordinating other agencies based on a marine data base and a method of calculating compensation for all existing resources. It is necessary to create a special procedural law system for environmental compensation considering the application of the precautionary principle, the polluter pays principle and strict liability in cases of tanker oil pollution which have special characteristics given the civil responsibility and liability for Protection & Indemnity (P&I) insurance.
Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana terkait pengelolaan sampah, mengetahui dan menganalisis bagaimana peran bank sampah dalam pengelolaan sampah dan mengetahui dan menganalisa bagaimana pengelolaan sampah yang berbasis masyarakat. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Data yang diperoleh dari penelitian ini data sekunder yang diperoleh melalui studi kepustakaan, kemudian data yang diperoleh dianalisis secara yuridis kualitatif melalui pendekatan perundang-undangan dan konseptual. Hasil penelitian ini menunjukkan bahwa (1) Sistem pengelolaan sampah merupakan proses pengelolaan sampah yang meliputi 5 (lima) aspek yaitu aspek kelembagaan; pembiayaaan; pengaturan; teknik operasional; dan peran serta masyarakat, (2) Bank Sampah dalam pelaksanaanya dapat mengurangi tingginya angka sampah di masyarakat dan di tempat pembuangan akhir (TPA). Sehingga, melalui Bank Sampah menjadi salah satu alternatif solusi bagi pemerintah maupun masyarakat dalam mengurangi terus meningkatnya volume sampah. (3) Pengelolaan sampah berbasis masyarakat sebagai suatu pendekatan pengelolaan sampah yang didasarkan pada partisipasi aktif masyarakat. Pengelolaan lingkungan hidup memerlukan adanya fasilitasi dan implementasi upaya berbasis masyarakat sebagai suatu strategi pemberdayaan dan peningkatan akses mereka kepada sumber daya lingkungan hidup.
This study aims to determine how the application of electronisc justice system (e-Court) in providing the principle of benefit for the parties in civil cases. This study uses a normative juridical approach with secondary data sources supported by primary data. The results showed that the existence of electronisc justice system (e-Court) can provide the principle of benefit for the parties including transparency of the process, cost, and time efficiency for justice seekers who are able to access IT (Information Technology) and the existence of dualism is still needed for justice seekers which still requires conventional proceedings due to limited access to IT (Information Technology).
Marine Insurance is a priority need nowadays considering Indonesia is an archipelagic state. Marine insurance related to tanker transportation regulated through the International Convention on Civil Liability for Oil Pollution Damage 1969 and the Protocol 1992 (CLC 1969). The CLC Convention was established to ensure adequate compensation for oil pollution victims due to tanker accidents. The Convention imposes liability on shipowners for the environmental losses from oil pollution. The Convention requires insurance for large tankers weighing 2000 tons or more for the prevention of damage to the marine environment. Indonesia, as a state ratifying the CLC 1969 must apply the obligations in the national legal system as the fulfillment of the precautionary principle of oil pollution by tanker accident. The approach method was normative juridical and the secondary data used in the discussion of the paper. Marine insurance in the form of the Insurance of Protection and Indemnity (P & I) as the protection for ship owners, operators, or tenants of legal liability to third parties is the application of Precautionary Principle in order to protect the rights of coastal states on their marine environments in international shipping lanes which are hazardous transports. The use of the principle included in the Circular Letter of the Minister of Transportation no. AL.801/ 1/ 2 Phb 2014 concerning the obligation to ensure vessels using vessel removal insurance and compensation protection. The nature of the imposition of vessel liability insurance addressed to ships in general.
