Entre os anos de 1500 a 1800, no período do Brasil Colônia, a soberania paternal era quem conduzia as crianças e jovens. Elas eram plenamente conduzidas pelas famílias as quais seguiam a legislação instituída pela soberania paternal. Nesse período não havia um sistema legal formatizado, os pais mantinham autoridade de definir qual seria a profissão e com quem iriam se casar. Estes enfrentaram um longo tempo da história, sem ter o adequado suporte judicial e político. Foi somente no século XX que o Estado começa a estabelecer normas à vida social e familiar, uniformizando a convivência entre seus integrantes.
