Em 23 de janeiro de 2002 falecia Pierre Bourdieu, recém-aposentado de sua cátedra de sociologia no Collège de France, provocando uma comoção públi-ca que suscitou pronunciamentos de autoridades como as do presidente da República, Jacques Chirac (gaullista histórico), do Primeiro Ministro e opositor do presidente, Lionel Jospin (socialista), de diversos outros representantes eleitos ou simples militantes, bem como de escritores, artistas, cientistas, filósofos e intelectuais das mais variadas procedências e ideologias, tudo com vasta cobertura da mídia. Mas não se imagine haver consenso nacional ou mesmo corporativo de intelectuais; esse sem-número de manifestações reeditou ainda os ataques virulentos expressos publicamente em anos posteriores à greve geral de 1995, como foi o caso de número integral do Le Nouvel Observateur, contendo ataques do editor, mas também do colega da École des Hautes Études en Sciences Sociales (EHESS), Jacques Julliard.1 Até o livro intitulado Do jornalismo depois de Bourdieu (Schneidermann, 1999) fez parte do debate. Como toda polêmica ácida, não foi época de tranquilidade, ou de recolhimento, para os adeptos de suas teorias ou admiradores de suas posturas intelectuais. Seria isto uma demonstração suplementar de que a controvérsia aberta é a única forma de se afirmar um novo "paradigma intelectual", algo inerente ao conceito de "campo" proposto pelo "sociólogo maldito"? A polêmica que suscitou, e que ganhou em intensidade nos anos finais de sua existência, prejudicaria o exame detido da pertinência dos enunciados de sua obra voltada para as ciências sociais?
This paper presents the main institutional changes in labor relations in Brazil, highlighting their impact on the organization of workers. A more recent central change is the regulation of outsourcing by the Labor Judiciary. Research into claims in the Superior Labor Court, guidelines from the Labor Prosecution Office, and trade union lawsuits, show that outsourcing and working hours are subjects which have directly affected health workers. By addressing the institutional principles of justice in contracts, it was concluded that labor reform should deal with the inequality of rights that have characterized the Brazilian labor market.
RESUMO:O artigo anuncia as questões que guiam a pesquisa em desenvolvimento e que podem ser assim resumidas: as relações individuais dos primeiros sociólogos do trabalho com os grupos hegemônicos dentro da sociologia universitária; sua integração nos outros institutos ou departamentos aos quais a sociologia oferecia seus quadros; a incidência de sanções políticas que tiveram o efeito de interromper ou de desviar suas carreiras; as probabilidades de exposição à circulação internacional das ideias, através dos deslocamentos pessoais ao exterior ou por seu pertencimento a redes internacionais; assim como também sua exposição diferencial à circulação das ideias entre as classes sociais, em particular com relação ao seu próprio objeto de estudo: a classe trabalhadora. A justiça do trabalho Nas últimas décadas, cientistas sociais têm se debruçado sobre a relação entre o protagonismo do Poder Judiciário e a consolidação de regimes democráticos constitucionais, tanto no que diz respeito à mediação de conflitos como à proteção de direitos. Assim, pesquisas sobre as instituições e os atores do mundo jurídico somam-se a análises dos graus e das formas de acesso à justiça, da relação entre instituições judiciárias e democracia, do pluralismo normativo e das formas alternativas de resolução de conflitos, bem como da efetividade do direito na prevenção de conflitos. Também no Brasil multiplicaram-se as pesquisas empíricas na área das ciências sociais sobre o mundo jurídico e sua relação com a sociedade, sobretudo após a democratização e a Constituição de 1988 1. A Justiça do Trabalho, no entanto, tem sido pouco estudada pelo mundo acadêmico, lacuna surpreendente sobretudo se levarmos em conta a filiação trabalhista de nossa cidadania social. Campo de lutas, alvo de disputa em torno de modelos diferenciados de sociedade e de institucionalização das relações capital/trabalho no Brasil, a Justiça do Trabalho foi, na última década, ameaçada sem sucesso por projetos de governo que previam transformações profundas ou mesmo sua extinção. Neste texto, pretendemos destacar a especificidade desse ramo da justiça, apontando para algumas particularidades do perfil de seus magistrados.
