Family resilience is a crucial factor to support community resilience, which later leads to the resilience of the nation and state. This study describes and analyzes family resilience through the use of agricultural zakat in Nagari Lima Kaum, Tanah Datar in West Sumatra. This study is empirical or sociological legal research that perceives law as a social phenomenon. Data collection techniques include interview and document study. This study concludes that the uniquetradition of paying zakat carried out by the local community in Nagari Lima Kaum known as basokek can strengthen family resilience. As seen from the accounting of zakat, while most of the muzakki belong to underprivileged community, they always issue zakat rice because this has been a religious tradition for generations believing that they must pay zakat. This tradition, however, tends to be abandoned, yet the essence of the practice is still carried out today. The zakat practice includes distributing payment of zakat rice to the poor, the needy, old widows, mosques, and even people who are studying. In overview, zakat is an activity aimed to increase piety to Allah s.w.t for the muzakki and fulfill basic needs for the mustahiq in realizing family resilience in the social and economic fields.
This study analyzes the cost determination for a gold pawn ujrah at the branch of Banque Syariah Mandiri Batusangkar. This type of research is field research with qualitative methods. The analysis technique is based on the Fatwa DSN and the theory advanced by Rozalinda. The research results explain that the implementation of the gold pledge at the branch of Bank Syariah Mandiri Batusangkar in accordance with the Standar Operasional Prosedur (SOP) that have been set by the Bank. The costs of administration, maintenance and storage of the pledged goods are determined according to the amount of the customer's loan, the level of fees also depends on the amount of customer loans. So this is not in line with Fatwa DSN No. 25/DSN-MUI/III/2002 regarding Rahn, in point four, stated that maintenance and storage charges should not be based on loan amount. It is also not in line with the theory advanced by Rozalinda that the administration of administrative costs is based on the weight of the gold, the cost of maintaining and storing or renting the premises according to the content of the gold.
This study focused on the implementation of hilah method within the concept of fatawa of DSN concerning with Sharia banking product agreement. The problems of the research was formulated as follows: "Does DSN determine the fatawa concerning with Sharia banking product agreement apply the concept of hilah?" This study belonged to library research which studied documents of fatawa of DSN. The method employed was normative qualitative using content analisys using the rules of istimbat. The study began with figuring out the position of hilah method in Islamic laws. Next, gathering and analyzing the fatawa of DSN concerning with Sharia banking product. The finding showed that the process of determination of some fatawa applied hilah method by modifying the format of fikih muamalah. Most of the determination of fatawa of DSN used hilah methods for the goode sake consideration. Kata kunci: hilah, fatwa DSN-MUI, akad PENDAHULUAN emicu fatwa ada yang disebabkan perubahan yang dialami oleh masyarakat, baik perubahan pola hidup atau karena perkembangan teknologi. Fatwa yang merupakan pendapat ulama bertujuan untuk menyelesaikan masalah-masalah hukum yang dihadapi masyarakat . Oleh karena itu fatwa bersifat domestik, situsional, dan temporal. Hal ini didukung oleh kaedah fikih yang dikemukakan oleh Ibnu Qayyim al-Jauziyah sebagai berikut : تغري الفتوى اختالفها و حبسب تغري ا ألزمنة ا و ألمكنة األ و ا وحو النيات و ائد العو و Berubah dan berbedanya fatwa sesuai dengan perubahan zaman, tempat, kondisi sosial, niat, dan adat kebiasaan. (Ibnu Qayyim al-Jauziyyah, 1975: 4) Mengaplikasikan sejumlah konsep fikih muamalah sebagai sumber sistem ekonomi syariah di Indonesia, terutama dalam produk perbankan syariah DSN-MUI mengeluarkan beberapa fatwa sesuai dengan jenis produk yang dibutuhkan. Proses penetapan fatwa mengikuti metode ijtihad, karena metode fatwa hampir sama dengan berijtihad yakni mengeluarkan hukum dan menetapkan hukum tentang sesuatu masalah yang tengah dibutuhkan masyarakat. Mujtahid mengistinbatkan hukum, mulai dengan menggali ayat-ayat dalam Alquran sebagai sumber hukum utama dan juga merujuk Hadis Rasulullah Saw. Menelaah maksud yang terkandung dalam Alquran maupun Hadis, ulama mengunakan akal pikiran sehingga melahirkan metode-metode baru dalam penetapan hukum suatu masalah.
