En este trabajo se plantea la idoneidad de los derechos de propiedad para proteger los derechos de las personas sobre el uso de su cuerpo o de partes del mismo. Los avances médicos y biotecnológicos actuales eran impensables hace no mucho tiempo. Están en juego, además, ingentes beneficios económicos. En consecuencia, surgen nuevos retos y conflictos que exigen respuestas. En un primer paso se examinan diferentes concepciones de propiedad, para pasar a continuación al debate acerca de la posibilidad de que el cuerpo humano o partes del mismo puedan tener la consideración de propiedades. Si, como parece a tenor de la jurisprudencia de diversos países, esto es posible, entonces hemos de preguntarnos acerca de los derechos de las personas cuyos cuerpos originan esas peculiares propiedades.Palabras clave: Cuerpo humano; derechos y libertades; propiedad. Book reviews115 Hospitality of the Matrix allows us to reflect about different future possibilities rather than actual realities: this is one of the virtues and merits of this book. Society's desires evolve by means of scientific discoveries and, vice versa, scientific progress is promoted and encouraged by ever-changing human needs and sociocultural shifts. So, redefining the concept of fatherhood and motherhood means reconfiguring the notion of hospitality both in the biomedical field -with reference to maternal/foetal relationships -and in the ethical area -with reference to self/other relations in the social context.
Este artículo surge de la pregunta acerca de la posibilidad de considerar la legislación sobre prostitución como actividad laboral dentro del derecho antidiscriminatorio. De una idea de derecho antidiscriminatorio un tanto heterodoxa. Para buscar respuestas a esa pregunta se analizan algunos de los lugares comunes en los debates acerca de prostitución: la cosificación de las mujeres, la validez del consentimiento para realizar esta actividad y la relevancia de la idea de autonomía, así como la mercantilización del sexo y la dignidad de las mujeres. De ese análisis se deriva que no habría razones definitivas para negar el reconocimiento de la prostitución como actividad laboral con unas características específicas, aunque la regulación legal derivada de ese reconocimiento habría de hacerse de tal manera que las mujeres tuviesen el control sobre sus condiciones de trabajo.
