The purpose of this research is to find out how legal protection for workers has harmed employers so that workers have been laid off. The type of research used in this study is normative research using the nature of the law approach as well as the theoretical point of view from scientific books and journals that function to provide solutions to existing legal problems. The results show that even though Article 164 paragraph (3) of Law Number 13 of 2003 must provide severance pay, award money, and services during the employee's working period and provide compensation. When workers are proven to be unproductive at work or have problems with the detriment of the employer, the employer can take action to terminate the employment relationship with the worker. From there, the Law does not prohibit companies from taking efficiency measures, but these efficiency actions are no longer valid if there are procedures or reasons that are not in accordance with the applicable regulatory requirements. With the existence of Law No. 13 of 2003 concerning Manpower, I hope that it can implement various national instruments that have been ratified, for example labor rights. This ambiguity makes the Indonesian people have to have strong policies and regulations on labor rights regulations, so that they can restore the wheels of Indonesia's slumping economy. Abstrak Tujuan penelitian yakni untuk mengetahui bagaimana perlindungan hukum bagi para pekerja yang telah merugikan pengusaha sehingga sampai para pekerja di PHK. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian normatif dengan memakai sifat pendekatan Undang-Undang serta sudut pandang teoritis dari buku dan jurnal ilmiah yang berfungsi untuk memberikan solusi terhadap permasalahan hukum yang ada. Hasil penelitian menunjukan bahwa Saat pekerja terbukti tidak produktif dalam bekerja atau memiliki masalah sampai merugikan pengusaha disitu pengusaha bisa mengambil tindakan untuk memutuskan hubungan kerja dengan pekerja. Dari situ Undang-Undang tidak melarang perusahaan untuk melakukan tindakan efisiensi namun tindakan efiensi tersebut menjadi tidak berlaku lagi jika ada prosedur atau alasan yang tidak sesuai dengan syarat peraturan yang berlaku. Adanya Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan saya harap bisa melaksanakan berbagai instrument nasional yang telah diratifikasi contohnya hak hak tenaga kerja. Ketidakjelasan tersebut membuat bangsa Indonesia harus memiliki kebijakan dan peraturan yang kuat atas peraturan hak para tenaga kerja, sehingga bisa mengembalikan roda perekonomian Indonesia yang terpuruk ini. The specific crime of narcotics is still something to be feared in Indonesia, the victims resulting from this problem are children. Even though the next generation of the nation are children who are in the growth stage, namely as survival assets for humans, the nation and the state. Children have rights in their hands, with this right, children need to have legal protection, which has the goal of guaranteeing a child will get a decent life. Narcotics itself has been regulated in general, this is explained by the presence of Law no. 35 of 2009 concerning Narcotics. Rehabilitation efforts as well as special rules that clearly regulate juvenile justice are explained in law number 11 of 2012. Abstrak Di Indonesia, tanah bagian dari tanggung jawab secara nasional untuk terwujudnya penguasaan, pemanfaatan, dan kepemilikan tanah. Tanah merupakan modal dalam pembangunan suatu bangsa dan dapat dimanfaatkan untuk kesejahteraan dan kemakmuran bagi warga negara. Seiring perkembangan global, banyak WNA yang datang ke Indonesia baik dalam rangka wisatawan, hubungan perkawinan, maupun urusan bisnis yang berlokasi di Indonesia sehingga membuka kesempatan bagi WNA untuk dapat memiliki alas hak atas tanah. Oleh karena itu, tujuan penulisan artikel ini untuk menelaah hak-hak atas tanah yang dapat dikuasai oleh WNA di Indonesia. Menurut Undang-Undang Pokok Agraria, WNA dapat menguasai tanah melalui hak pakai atau hak sewa untuk bangunan. Di beberapa regulasi lain WNA juga dapat mendirikan rumah di atas tanah hak pakai, dapat juga memperoleh tanah yang berasal dari hasil perkawinan dengan WNI setelah adanya perjanjian pemisahan harta. Namun, sifat hak milik sebagai hak terkuat menjadi incaran para WNA dengan melakukan penyelundupan hukum, sehingga pada praktiknya sering terjadi WNA dan WNI melakukan perjanjian hak milik atas tanah melalui perjanjian nominee trustee agreement. Oleh karena itu, maraknya praktik tersebut harus direspon dengan penguatan hukum pertanahan agar WNA tidak dengan mudah melakukan penyelundupan hukum dalam memperoleh hak atas tanah. Abstract In Indonesia, the land is part of the national responsibility for realising land tenure, use and ownership. The land is the capital in the development of a nation. It can be used for the welfare and prosperity of citizens. Along with global consequences, many foreigners who come to Indonesia for tourists, marital relations, and business affairs are located in Indonesia, thus opening up opportunities for foreigners to have land rights. Therefore, the purpose of writing this article is to examine land rights that foreigners in Indonesia can control. According to the Basic Agrarian Law, foreigners can control land through usufructuary rights or rental rights for buildings. In several other regulations, foreigners can also build houses on land with usufructuary rights and acquire land from marriages with Indonesian citizens after an agreement on the separation of assets is made. However, the nature of property rights as the most vital right has become the target of foreigners by conducting legal smuggling. In practice, foreigners and Indonesian citizens often enter into land ownership agreements through a nominee trustee agreement. Therefore, the rampant practice must be responded to by strengthening the land law so that foreigners do not easily carry out legal smuggling in obtaining land rights.
The world was shocked by the emergence of an infectious virus called COVID-19 at the end of 2019. Viruses that can be transmitted by camouflage by indiscriminately consuming every human life that lives on the surface of this earth, including in Indonesia. Indonesia is one of the countries with the most COVID-19 cases in the world, which has implications for the country's economic condition. Even in the health of the People of Indonesia with a fairly high death rate. The government then made a policy with the aim of minimizing the explosion of the number of COVID-19 victims who are increasing and harming many parties. The Government issued Law Number 2 of 2020 on The Establishment of Government Regulations in Lieu of Law Number 1 of 2020 on State Financial Policy and Financial System Stability for Handling the Coronavirus Disease Pandemic 2019 (Covid-19) and/or in Order to Deal with Threats that Endanger the National Economy and/or Financial System Stability into Law. This research uses a type of juridical normative research with a level on applicable laws and regulations.The policy regarding this rule has actually been implemented properly. However, the rights of the people related to the existence of Law Number 2 of 2020 are still not implemented properly. Further arrangements are needed that are more in favor of the condition of the people and the country's finances for the realization of good and clean government, so that the handling of the COVID-19 pandemic is in accordance with the common expectations of the Indonesian people.
