IntroduçãoOs mercados e os contratos de trabalho "informais" têm sido percebidos no Brasil como problemas econômicos e sociais, pois representam rupturas com um padrão contratual único (ou quase único), isto é, o contrato "formal". Subjacentes a essa afirmação há duas premissas: (1) a boa sociedade deve ter apenas um tipo de contrato (o "formal") e (2) para isso deve contar com algum órgão central (o Estado, por meio do poder Legislativo) que defina padrões mínimos de legalidade para os contratos de trabalho. A noção de "informalidade" é tanto mais problemática quanto mais a noção de "padrões mínimos legais" não é consensual. Desde meados da década de 1990 as noções de mínimo estão em debate no Brasil, embora verbalizadas sob a forma de flexibilização.De fato, o significado da dupla conceitual "formal"/"informal" não é claro, assim como não há coesão sobre a pertinência de contratos homogêneos nem sobre o papel da legislação nos contratos de trabalho. Argumentamos que somente quando tivermos identificado os diversos tipos ou grupos de "contratos atípicos" (conceito que talvez seja preferível ao de "informalidade'), previstos ou não pelas leis, poderemos definir as eventuais inconveniências da ausência de um padrão contratual único e, principalmente, identificar as razões da existência de contratos atípicos e ilegais ou não previstos em lei e socialmente ilegítimos.O conceito de "informalidade", embora muito adotado pelas ciências sociais e econômicas brasileiras, refere-se a fenômenos demasiadamente diversos para serem agregados por um mesmo conceito, como a literatura internacional vem apontando. 1Em trabalhos anteriores em que analisamos as greves no Brasil entre 1978 e início da década de 1990 constatamos que esse foi um ciclo sem precedentes na história brasileira por suas características e por sua intensidade, tendo atingido entre 1985 e 1992 um dos maiores níveis de paralisações da história dos países ocidentais.
