La codificación española se ha abordado siempre con carácter parcial agrupando cada una de las grandes áreas temáticas del Derecho y analizando las peculiaridades de la codificación en cada una de esas áreas. Pero no existe una historia institucional de las diferentes Comisiones de Códigos, previas a la Comisión General de Codificación, vinculadas en mayor o menor medida al Ministerio de Justicia. Este trabajo, que es continuación de otros dos anteriores, trata de reconstruir la codificación a nivel institucional en cuanto a órganos del Ministerio, a través de su funcionamiento y de las personas que participaron en las mismas a fin de poder elaborar teorías ideológico acerca de sus actuaciones y toma de decisiones, centrándose en dos periodos del reinado isabelino: la década moderada y el bienio progresista.The Spanish codification has been approached always by partial character grouping each of the big thematic areas of the Law, and analyzing the peculiarities of the codification in each of these areas. But there does not exist an institutional history of the different Commissions of Codes, before the General Commission of Codification, linked in major or minor measure to the Department of Justice. This work, which is a continuation of other two previous ones, tries to reconstruct the codification to institutional level as for organs of the Department, across his functioning and of the persons who took part in the same ones in order to be able to elaborate theories ideologically it brings over of his actions and capture of decisions, centring on two periods of the Elizabetahn reign in Spain: the «Decada Moderada» and «Bienio progresista» (the progressiv period of two years).
Protocolo y relaciones institucionales van de la mano en la mayoría de las instituciones públicas. En un mismo departamento se realizan ambas funciones. Pero hay que tener en cuenta que son campos paralelos pero que conviene diferenciar para evitar que en la organización de actos o eventos desviemos la atención de los auténticos públicos a los que los mismos van dirigidos.__________________________________Protocol and institutional relations go hand in hand in most public institutions. Both functions are performed in the same department. But we must bear in mind that they are parallel fields but that it is necessary to differentiate to avoid that in the organization of events or events we divert the attention of the authentic public to whom they are directed.
Resumen:En esta publicación se trata de analizar la aplicabilidad del Decreto de Precedencias de 1983 creado ex profeso para la nueva estructura constitucional, aún vigente y totalmente inadecuado con la realidad institucional y política actual, de forma que debe modificarse a base de costumbre ante la falta de intencionalidad política alguna de acometer su reforma.Abstract:The purpose of this publication is to analyze the applicability of the 1983 Precedence Decree created for the new constitutional structure, still in force and totally inadequate with the current institutional and political reality, so that it must be modified on a customary basis in the absence of political intentions to undertake its reform.
Entre las ciencias jurídicas, el protocolo se concibe como buenas maneras, educación, código de conducta, ética, o como la ropa o los zapatos que uno debe ponerse para acudir a un acto que exige una determinada etiqueta. Como algo frívolo, sin importancia, que no atañe al común de la sociedad, propio de las clases elevadas y de los gobernantes y de la diplomacia. Por supuesto, cuando dices que eres protocolista, que eres especialista en protocolo y que te dedicas a investigar el protocolo, te preguntan "pero ¿eso es derecho?". En definitiva el protocolo es una disciplina despreciada por los juristas que la han ido dejando de lado, salvó en un sector: el diplomático. Los diplomáticos son los únicos conscientes de lo importante que es el ceremonial y el protocolo en las relaciones internacionales, y por ello los cursos de la Escuela Diplomática son referente ineludible a la hora de estudiar protocolo. Este estudio reivindica el protocolo desde su carácter de disciplina jurídica.______________________Among the legal sciences, protocol is considered to be good manners, courtesy, code of conduct, ethics, or the clothes and shoes one should wear to an event where dress code is required; something superficial, unimportant, not related to society at large, characteristic of the upper classes, rulers and diplomacy. Of course, when you say you are a protocol expert and that you do research in protocol, you will be asked “Is that law?” Ultimately, protocol is a discipline despised by jurists, who have gradually set it aside, with the exception of the diplomatic community. Diplomats are well aware of the importance of ceremonial and protocol in the international relations, and thus the Diplomatic School courses are essential when studying protocol. This study claims the protocol as a legal discipline.

Considerad lo que estiméis.Conocí a José Luis Delgado en la III edición del Curso Extraordinario de Protocolo, Comunicación e Imagen Corporativa organizado por la Universidad de Salamanca y dirigido muy sabiamente, con profesionalidad y rigor por él mismo.Desde el momento en el que intercambié las primeras palabras con José Luis, me pareció una persona afable y cercana, a la vez que serio. Debo decir que tuvo "algo", eso que no se explica con palabras, que nos toca y parece magia. Con su mano izquierda, su intenso amor por el Protocolo nos enseñó a apreciar cada detalle y hacer nuestra una profesión independientemente de que nos fuéramos a dedicar a ella o no. Le guardaba un gran respeto y cariño, de hecho, fue de quien aprendí la frase de Talleyrand "Solo los necios se ríen del Protocolo, simplifica la vida". Además de su rigor y profesionalidad en sus clases, en las que disfrutaba, no había más que verle, ponía de manifiesto su gran humildad al presentarnos a los demás ponentes del curso, les apreciaba y reconocía sus trabajos sinceramente y predisponía a la escucha atenta.Permanecimos en contacto por lo cercano que era, porque deseaba crear interacciones futuras y porque era una persona interesantísima, con un gran bagaje cultural, la "formación humanística" que nos refería debía poseer un profesional del Protocolo.Gran persona, altruísta (siempre tenía tiempo que no le sobraba para dedicárnoslo), sensible, sabía escuchar, excelente comunicador, entusiasta hasta en las más bravas lecciones de la vida, único, profesional, riguroso, sutil...Doy gracias al Cielo por haberle conocido.
