The relationship between crime and punishment has never been isolated. Under the influence of socio-economic, political, and cultural changes, metamorphoses of the institution of execution of punishments took place; in particular, the rights of convicts were liberalized. Therefore, it is necessary to analyze the historiography of this phenomenon in terms of international standards, as well as the peculiarities of their implementation. The work aims to characterize the implementation of international standards on the rights of prisoners in terms of historiography and legal regulation. The object of research is the norms of international law. The subject of the study is social relations that arise in the implementation of international standards on the rights of convicts in prisons. The research methods were dialectical, systemic, structural, formal-legal, historical-legal, methods of analysis, synthesis, induction, and deduction. As a result, international standards for the rights of prisoners serve as a model, an example of rational social relations in the penitentiary environment. Key aspects that should be universally considered by the governments of all countries are identified and described.
У статті звернено увагу на недостатній рівень дослідження проблеми формування злочинних угруповань у місцях позбавлення волі. Наголошено, що формування злочинних угруповань є характерним для виправних колоній різного рівня безпеки. Також виокремлено чинники, які зумовлюють формування подібних угруповань в установах виконання покарань. Виділено спектр проблем, які потребують наукового аналізу у контексті досліджуваної проблематики. Проаналізовано стан наукового забезпечення проблеми на сучасному етапі розвитку теорії оперативно-розшукової діяльності. Розроблено класифікацію злочинних угруповань за формою базової злочинної діяльності; системою та інтенсивністю зв’язків злочинного угруповання; ідеологічним підґрунтям злочинної діяльності.
One of the factors influencing the effectiveness of sustainable development of the society is the state of the organization of the fight against crime, which is an integral part of any community. The success of the models of influence on crime chosen by the state depends on: the structure and dynamics of criminal activity in society; the intensity of the processes of self-reproduction of crime; the extent of public involvement in illegal social practices; the impact of criminal structures on economic, and political processes. The purpose of the work is to analyze the nature and structure of operational and investigative activities in places of imprisonment. The research methodology: dialectical method; method of analysis; formal-logical methods; synthesis method; system-structural method; methods of induction and deduction; statistical methods; and method of scientific abstraction. As a result of the study, the authors of the article came to the conclusion that operational and investigative activities in places of imprisonment are specific activities that differ significantly from other areas of operational and investigative activities, and require serious theoretical consideration.
The source of law, the case-law of the European Court of Human Rights (hereinafter – the ECtHR), is playing an increasingly significant role in the practice of judicial proceedings in Ukraine. The activities of the ECtHR significantly affect the implementation of the principle of the rule of law in Ukraine in criminal proceedings. Therefore, the phenomenon of judicial precedent and the application of ECtHR practice in criminal law requires comprehensive analysis. The work aims to study the case law and practice of the ECHR in criminal law, problems of theory and practice of application of court precedents by national courts, and ways to solve them. The research methodology consists of such methods as historical and legal; comparative law; formal and logical; empirical; cognitive; method of analogy; synthesis method; method of analysis. The value of ECtHR decisions is that such decisions, more quickly than other criminal procedural means, make adjustments to the law enforcement process of public authorities, thus improving the mechanism of criminal procedural regulation to guarantee conventional and constitutional human rights. In addition, the recognition of the case law of the ECtHR as a source of law is necessary for the adaptation of national legislation of Ukraine to the legislation of the European Union. Although legal precedent is not officially recognized as a source of law in Ukraine, the decision of the ECtHR recognizing case law can be considered in Ukraine as a rule of law.
