The article focuses on the issue of implementation of Directive 2019/1 to empower the competition authorities of the Member States to be more effective enforcers and to ensure the proper functioning of the internal market. It discusses recent developments in competition law with a special focus on fining powers of the national competition authorities (NCAs). The article compares different approaches adopted by EU Members States, with a special focus on Poland and France, to implement provisions of the ECN+ Directive referring to antitrust fines and limitation periods. The article sheds light on the process of implementation and problems encountered by national legislators. This article analyses steps taken towards uniformity in this area of law within the EU. It contributes to the research on how NCAs approach the enforcement of competition law and ensure the deterrent effect of antitrust fines. The conclusions cast doubt on the effectiveness of raising the level of fines as a means of enhancing enforcement if it is not supported by other measures such as a coherent fining policy or sanctions ensuring compliance. The methodology used in the article includes descriptive research based on an analysis of relevant provisions of national law and EU law relating to fining powers of NCAs.
If Code is law, then Code is contract ? -Le discours sur les smart contracts oscille entre virtualités et fantasmes 1 . Il fait partie de ces sujets qui obligent le juriste à faire preuve d'imagination en privilégiant une approche spéculative au détriment d'une approche descriptive. Les juristes doivent cependant appréhender une technologie, celle des smart contracts rattachés aux blockchains 2 , qui prétend à terme se passer de leurs services ! Une question récurrente revient à l'esprit : If Code is law, then Code is contract 3 ? 2. De la blockchain au smart contract : le genre et l'espèce -Pour comprendre toute la place légitime qui revient au juriste dans la mise en place et la mise en oeuvre des smart contracts, il convient de rappeler de quoi il est question 4 . Si le smart contract a aujourd'hui autant de succès c'est parce qu'il profite de la technologie des blockchains. Sans entrer dans le détail, la blockchain est une technologie combinant le système de hashage, le processus peer to peer et la sécurité des clefs cryptographiques asymétriques. Elle a pour objet la transmission et le stockage de données sur un réseau, usant d'un système de contrôle décentralisé, sans intervention d'un tiers de confiance. Les données figurant sur la blockchain, vérifiées et validées par l'ensemble des utilisateurs du réseau (les mineurs) au moyen de systèmes variables (preuve de travail, preuve par consensus…), sont censées être immuables, inaltérables et infalsifiables. La blockchain est dite publique, la seule et unique chaîne de blocs selon les puristes libertariens. A ce titre, tout participant est sinon « anonyme », du moins bénéficie-t-il d'un pseudonyme.
