RESUMEN: El presente artículo pretende aclarar el contenido de la reclamación china sobre el Mar del Sur de China, a pesar de una falta de declaración completa y detallada de este, para determinar si se ajusta al moderno derecho del mar. Para esto, examinamos los actos de la República Popular China, la opinión de la doctrina respecto al tema y fi nalmente los puntos discutidos en el arbitraje sobre el Mar del Sur de China, un caso contencioso iniciado por la República de Filipinas.Palabras clave: Mar del Sur de China, Derecho del mar, derechos históricos, solución de controversias internacionales, arbitraje.ABSTRACT: The present article intends to clarify the content of the Chinese claim over the South China Sea, despite the lack of a complete and detailed declaration of it, in order to determine if it adjusts to the modern law of the sea. In doing so, we review the acts of the People's Republic of China, the opinion of experts on the subject and the issues discussed in the matter of the South China Sea arbitration, a contentious case initiated by the Republic of the Philippines. Malasia, en 1966, promulga una ley sobre plataforma continental 4 emulando las instituciones de la Convención de Ginebra sobre Plataforma Continental y, en 1979, publica un mapa ofi cial delimitando su reclamación sobre zona económica exclusiva y plataforma continental 5 . Brunéi reclama dos confi guraciones marítimas particulares, bajo la tesis de la extensión de su plataforma continental.Es relevante señalar, en este punto, que el Mar del Sur de China se convirtió en una zona altamente disputada, a partir de la realización de un informe de la Comisión Económica para Asia y Lejano Oriente 6 , dependiente del Consejo Económico y Social de las Naciones Unidas de 1969, que sugería la existencia de recursos petrolíferos en el subsuelo marino de la región. El 20 de febrero del mismo año, la Corte Internacional de Justicia enunciaba el principio de la prolongación natural en el caso de la Plataforma Continental del Mar del Norte 7 .Es a partir de estos hechos, que los países ribereños empezaron a elevar sus reclamaciones y a tomar el control, la mayoría de las veces militar, de las confi guraciones insulares presentes en el área.Lo anterior queda para un análisis político de la controversia, pero claramente tiene como consecuencias la confi guración del contenido de las reclamaciones.El actor más importante en esta disputa es, sin lugar a duda, la República Popular China, el cual, a pesar de reivindicar casi la totalidad del Mar del Sur de China, no ha detallado de forma precisa el contenido de su reclamación. El único elemento del cual no hay discusión es su alcance geográfi co, ya que viene señalando, desde más o menos 1946, que tiene soberanía respecto de una línea interrumpida, denominada línea de nueve guiones 8 , que encierra en forma de U, casi la totalidad de las aguas y confi guraciones marítimas del Mar del Sur de China....
