O objetivo deste artigo é analisar a possibilidade da criação de novos direitos mediante a atuação do Supremo Tribunal Federal. Utilizou-se como ponto de partida os estudos sobre teorias da Constituição Viva (Living Constitution), concretistas de interpretação, sentenças manipulativas e diálogo institucional. Realizou-se a pesquisa por meio da análise documental de decisões do Supremo Tribunal Federal proferidas nos últimos cinco anos, que versaram sobre direitos de grupos minoritários ou vulneráveis. A escolha por casos envolvendo esses grupos ocorreu em virtude de serem os que normalmente possuem menor representatividade e mais necessitam de tutela jurisdicional. Por intermédio do método dedutivo, buscou-se verificar, nessas situações, em que medida a Corte buscou a solução mediante a sua própria decisão, optando por preencher a lacuna por meio de uma sentença aditiva, e quando optou por provocar o diálogo institucional com os demais poderes, visando a solucionar o caso proposto. Os resultados encontrados mostraram que de fato a Corte em alguns casos tem optado por impor ordens e em outros sugerir medidas aos demais poderes adotando postura dialógica para obter a solução do caso em discussão.
