El reclutamiento de niños para su utilización en roles de combate en contextos de conflictos armados no internacionales aumenta cada año. No obstante, entre las normas del derecho internacional humanitario (dih) parece existir una ausencia de regulación del targeting de niños. Motivados por la fuerte carga moral de la materia, varios autores han utilizado un análisis de complementariedad entre el derecho internacional de los derechos humanos (didh) y el dih para argumentar el otorgamiento de mayor protección a niños desprotegidos contra el ataque. El presente artículo argumenta que aquello es posible solo respecto del proceso de determinación de la participación directa en las hostilidades (pdh) o la función continua de combate (fcc) de niños, mas no cuando esta determinación ya ha sido hecha, debido a que los principios fundamentales del dih actuarían como un límite lógico para los análisis de complementariedad.
