<span>El presente trabajo es una exploración histórica crítica de la institución policial en su función de control social en Colombia hasta el periodo histórico conocido como la regeneración. Para tal efecto, se han estudiado tanto los textos legales, como la realidad social, atinentes a la Policía, entendida en sus dos acepciones: función y estructura institucional. De dicho análisis se constata una gran paradoja: mientras que la mayoría de las competencias asignadas eran de tipo administrativo, dichas atribuciones permitieron una omnipresencia de la Policía como ente de control social más allá de lo estrictamente penal.</span>
<p>La aproximación que se efectúa en el presente estudio, inicia con un acercamiento al concepto de conciliación como mecanismo alternativo de resolución de conflictos, estableciendo los rasgos generales de esta figura; para posteriormente analizar el antecedente inmediato de la conciliación preprocesal en la ley 600 de 2.000, que abrió camino para concederle en materia penal a este mecanismo mayor importancia.</p><p>Subsiguientemente se profundiza en la conciliación preprocesal consagrada expresamente en la ley 906 de 2004, y se analizan los cambios generados, para así conocer sus características, y determinar sus principales aportes, en el marco del sistema penal acusatorio.</p>
El artículo presenta un avance de investigación alusivo al rol que desempeñan las diferentes teorías referidas a la soberanía sobre los recursos hídricos compartidos por Estados y analiza su pertinencia y utilidad, con el fin de identificar los elementos que puedan aportar a la construcción de una teoría novedosa de la soberanía sobre estos recursos, que garantice de forma óptima su protección y preservación ambiental. Para lograrlo, en primer lugar, se exploró el concepto de soberanía y los diferentes postulados que se han planteado al respecto para, en segundo lugar, profundizar en el análisis de las teorías de la soberanía concernientes al ejercicio de poder sobre los recursos hídricos. Entre dichas teorías se encuentra una variada gama de concepciones que van desde la soberanía territorial absoluta y la integridad territorial absoluta, hasta las restrictivas, basadas en el abuso del derecho, en las servidumbres internacionales y en las relaciones de vecindad, así como la referente a la comunidad de intereses y a la de cuenca hidrográfica internacional, todas las cuales conducen, en tercer lugar, a proponer la teoría de la soberanía común de los recursos hídricos compartidos.
