El constitucionalismo y el autoritarismo se presentan como opuestos e irreconciliables. Sin embargo, la experiencia autoritaria en el mundo y en América Latina demuestra que este fenómeno se puede servir de narrativas constitucionales. Por esto, se ha desatado una expansión en la literatura jurídica preocupada por cómo afrontar esta relación. Este artículo argumenta que, pese a esta nueva literatura, la obra del profesor Roberto Gargarella aporta insumos valiosos para el fortalecimiento democrático de la región, que parten del reconocimiento de las dinámicas del constitucionalismo latinoamericano, como su carácter contramayoritario.
Este artículo presenta una lectura sobre el Procedimiento Legislativo Especial para la Paz, conocido popularmente como fast track, y su papel dentro de la transición política colombiana. La lectura enfrenta la interpretación de que el fast track fue un mecanismo poco eficaz para la implementación legislativa del Acuerdo de Paz, e intenta explicar esto a través de dos puntos de análisis. El primero presenta la dificultad de implementar las reformas constitucionales que necesitaba el Acuerdo sin activar el poder constituyente originario, lo cual hizo necesario flexibilizar la Constitución para integrar los pilares del Acuerdo a la Carta Política. El segundo ahonda en el concepto de aporía constitucional, es decir en la dificultad lógica de reformar la Constitución a través de la distinción de competencia entre poder constituyente originario y derivado, y sus consecuencias en la rigidez y flexibilidad de la Constitución.
Este texto reacción al articulo El Estado Actual del Derecho Constitucional Comparado: Una crítica democrática" de Joel Colón Rios a traves de dos críticos. El primero es una crítica que llamo “el elefante debajo del mantel” en donde cuestiono la estabilidad del ideal liberal dentro del derecho constitucional comparado. Lo que busca es mostrar que el derecho constitucional comparado no es campo tan estable como lo presume Colón Ríos y que, por el contrario, hay proyectos comparados que parten desde ideal democrático que tienen influencias dentro de los autores dominantes del campo, como Tom Ginsburg. El segundo es una crítica que llamo “el problema del binarismo entre ideal liberal y el democrático”. Este crítica cuestiona la salida que ofrece “J” ante el rol dominante del ideal liberal dentro del derecho constitucional comparado que consiste en desplazarlo por el ideal democrático. Pues esto reproduciría algunos problemas, en particular los puntos ciegos en la descripción solo que desde otra perspectiva. En cambio, mi argumento es que el problema está en creer que las constituciones tienen una funcionalidad limitada a dos ideales, el ideal liberal y el democrático.
Este artículo explora la relación entre el resentimiento y el derecho penal. El resentimiento se explora a través de la experiencia de dos personas que habitaron dos espacios diferentes, pero que sufrieron eventos límites que marcaron su existencia. Jean Améry, por un lado, quién fue torturado por el simple hecho de ser judío por el régimen nazi, en el terrible campo de concentración de Auschwitz. Y Claudia Ospina, por el otro, quién fue violada y torturada psicológicamente por paramilitares colombianos, solo porque era una mujer que demostraba conocimiento acerca de derechos humanos. Ambos resentimientos, al tiempo tan diferentes y similares, se entrecruzan con diferentes conceptualizaciones del derecho penal, valorando la posibilidad de este tipo de derecho para aliviar aquel sentimiento.
