Tins mining at Belitung Island had been started since 17th century, since the era of British colonialism, Dutch, Japan invasion until independence era and nowadays, tins exploitation still exists. Tins mining activities make an impact to living environment condition in Belitung island. Hundreds holes of tins exploration called “kolong” (pit) can be found easily. In good mining practice context and mining regulation, tins mining exploitation should be ended with reclamation, so, the impact of environmental damage could be minimize. But, in implementation there are many problem, such as neglect of reclamation obligation, minimum realization, wrong perception about reclamation guarantee, the results of the reclamation that being mined again, and lack of supervisions. This research focused to analyze some of those problems in a integrative law enforcement framework. This research is a qualitative research with primary data and secondary data. The data collection techniques are through literature study and interviews with related stakeholder, and also do observations at reclamation sites. This research show that reclamation responsibilities Implementation’s problems caused by many factors, and through integrative law enforcement approach focused on three study’s components, which is legal substance, legal structure components, and legal culture components can encourage tins mining reclamation at Belitung Island in line with good mining practice principle and sustainable development with environmentally conception.
The principle of mining that is environmentally sound has in reality not been fully implemented properly in Belitung Timur Regency. Data and facts indicate that the reclamation obligation is not optimal by holders of Mining Business Permits (MBP), especially illegal mining activities that massively damage the environment and the absence of reclamation and post-mining efforts. people’s mine. Based on the above problems, this paper focuses on how to build a legal culture environment for mining communities in Belitung Timur. This research is a qualitative study with primary data and secondary data. Data collection techniques through literature and Focus Group Discussions with related stakeholders, as well as observations to mining sites. The study of legal awareness in the management and protection of the environment becomes interesting when faced with mining activities that are seen as not environmentally friendly, but always carry the mission of sustainable and environmentally sound development.
Products with geographical indication have massive potential to be a nation’s flagship commodities in local and international trades. It could be caused for specific reputation, superior quality, specific characters due to geographical environment factors (nature, humans, and combination both of them). Therefore, it is a great importance to provide special protection for goods or products that fall into the GI category. A flagship’ commodity from Bangka Belitung Islands, white pepper is a registered geographical indication with the name of Lada Putih Muntok (Muntok White Pepper). This brand name was created by Bangka Belitung Islands Province’s Pepper Management, Development, and Marketing Agency (BP3L). A legal protection by using a flagship commodity has a flagship commodity, this protection effort has a tremendous role in environmental preservation. Through this normative paper, this study attempts to convey the nature of geographical indication, the substance of the existing regulations, and their relation to environmental preservation, especially the relation between the geographical indication of pepper and the environment of Bangka Belitung Islands Province. This qualitative study employed literature review for data collection, with statutory rules and regulations as the primary data. Two approaches used were statute approach and conceptual approach. From the result of the research found that there is a relationship between geographical indications and environmental factor, including Lada Putih Muntok. With the approval of a geographical indication, there is obligation that must be carried out by the government and the community, namely maintaining reputation. One way to maintain reputation is to maintain the quality of the environment in the area.
Province of Bangka Belitung Island is one of Indonesia's regions that has the largest tin content in the world so that this region is one of the orogenese pathway that is a region of the world's most prosperous track.On its current development, tin mining has caused many issues such as the rampant practices of illegal mining in its land and sea, mining accidents, tin smuggling, conflicts of interest, social conflict, reclamation responsibility that are not optimally fulfilled like massive environmental damage in the middle of eco-friendly mining jargon that keeps on being campaigned. Therefore, tin management requires development reconstruction of eco-friendly environment as a green constitution trial. This paper examines many issues of tin mining that have occurred in Bangka Belitung Island, especially related to the environmental degradation as an implication of the tin mining process.Then this issue becomes one of bases in reconstructing development of eco-friendly environment as a green constitution trial.The results of the study show that tin mining activity in Bangka Belitung Island is an excavate soil activity to extract mineral content, that can change the mined area's landscape.Therefore, the reconstruction is absolutely necessary.
Legal policy is an official policy that is enforced by either adding new laws or by replacing old laws with new ones in order for a country to accomplish its goals. In environmental context, attention to legal policy becomes crucial, especially when associated with massive mining that takes place in some areas. In other words, mining activity in all its forms and operational methods is bound to be influenced by government’s environmental policies, including those in the form of laws and regulations. Since environment and mining affect each other, they are inseparable. The substances of environmental policies affect policies in the mining sector. Hence this normative study aims to do a mapping of environmental policies in regards to tin mining in Bangka Belitung. The data collection technique employed in this qualitative study was literature review, with laws and regulations as its primary data. This study used two approaches, namely statute approach and conceptual approach.
