El siguiente estudio analiza la tradicional regla de que la obligación solidaria de deudores no se presume. Se sostiene que dicha regla está evolucionando hacia el criterio inverso, a saber: de presunción de la solidaridad. Este fenómeno se aprecia principalmente a nivel internacional, pues se adecua mejor a las exigencias de una economía global. El estudio parte con un examen de la evolución del principio de la no presunción de la solidaridad en el siglo XIX, enfocado en aquellos códigos civiles europeos que han marcado las pautas en esta materia. En la segunda parte se revisan los principales intentos de atenuar o hasta eliminar el mencionado principio de algunos ordenamientos jurídicos durante el siglo XX. En tercer lugar se examinan las normas de soft law del siglo XXI que consagran la regla contraria, de presunción de la solidaridad. Finalmente se concluye que se debe repensar el principio de la no presunción de la solidaridad, el cual es todavía dominante en los sistemas
