Esta pesquisa analisa a transformação do direito ao meio ambiente sadio em um direito humano, bem como a internacionalização deste direito, alinhado a percepção da existência dos danos transfronteiriços, fez evoluir seu estudo e regulamentação, culminando no surgimento e desenvolvimento do Direito Internacional Ambiental. Após, inicia-se o estudo sobre a Responsabilidade Internacional do Estado pela prática de um ato ilícito internacional, ou seja, quando este viola uma regulamentação e lesa o direito de um outro Estado soberano ou área territorial fora de sua jurisdição nacional, traçando as principais características deste instituto na seara ambiental. Passa depois a examinar a Responsabilidade comum, mas diferenciada dos Estados, quando estuda essa forma de responsabilização estatal como princípio do Direito Internacional Ambiental, demonstrando também como sua positivação em várias normatizações internacionais contribui para integração mundial dos países na busca pela recuperação ambiental terrestre e pelo desenvolvimento sustentável. Por fim, na sua conclusão, disserta sobre como a proteção internacional do meio ambiente é viabilizada por estes dois tipos de responsabilização estatal.
O objetivo central deste estudo é analisar a ideia do desenvolvimento sustentável, partindo de uma leitura pormenorizada dos princípios que norteiam o Direito Ambiental, em especial o princípio da precaução. Busca-se, desta forma, delimitar e visualizar a linha tênue entre o fomento ao desenvolvimento socioeconômico e a degradação do meio ambiente, dentro do paradigma de uma Sociedade de Risco. Faz-se uma análise mais específica no que diz respeito aos alimentos geneticamente modificados, de modo a buscar uma decisão balanceada entre os seus benefícios e as irreversibilidades dos danos causados por estes.
