El presente artículo analiza cómo la tensión entre la globalización de la salud y el papel del Estado social de derecho colombiano repercute en el proceso de consentimiento informado en el ámbito de la relación médico-paciente. Con base en el método de revisión bibliográfica y mediante una investigación cualitativa de tipo descriptiva-analítica, se logra evidenciar que la globalización ha suscitado la despersonalización y la deshumanización del ejercicio de la medicina, junto con el deterioro de la confianza y el canal comunicativo entre el médico y el paciente, de modo tal que no permite un correcto proceso de consentimiento informado. Ante esta situación, Colombia, como Estado social de derecho, ha fallado en la inspección, la vigilancia y el control eficiente —libre de intereses particulares— del sector salud, lo cual no permite una atención de calidad con un intercambio de información adecuado para la toma de decisiones reflexivas en torno a la vida y a la salud. Lo anterior lleva a concluir que existe la necesidad de que el Estado, a través de sus instituciones, sea soberano y congruente con sus funciones a fin de enfrentar la situación y garantizar de forma efectiva los derechos del paciente.
