Este artículo presenta la eficacia como estrategia pedagógica que permite el estudio del derecho mucho más allá de la tradicional apuesta positiva y dogmática, admite un proceso de enseñanza-aprendizaje que conlleva la interrelación entre dogmática, semiótica y realidad sociopolítica, que permite analizar un derecho vivo y en disposición al servicio del sistema al que pertenece. Se propone un estudio holístico desde tres enfoques; la eficacia de la norma jurídica desde su capacidad para producir efectos jurídicos, la eficacia de la norma jurídica para motivar su aplicación y la eficacia de la norma jurídica desde el poder que tiene la norma para generar símbolos.
Desde una perspectiva socio histórica, se analizan las eficacias e ineficacias alcanzadas por la CEDAW dentro del contexto argentino. El texto expone la construcción del conjunto normativo que hace operativa a la convención y los paradigmáticos casos de Marita Verón y Olga del Rosario Díaz. El análisis entrelaza las repercusiones positivas y negativas que sobre prácticas jurídicas y políticas provocan las movilizaciones sociales, la producción normativa y la labor de organismos internacionales de derechos humanos como factores condicionantes internos y externos de la eficacia. Para ello se aplicó un diseño metodológico cualitativo, sobre datos documentales y secundarios que permitió concluir la existencia de una eficacia normativa formal de los derechos de las mujeres en Argentina que no se materializa plenamente en las eficacias instrumentales y simbólicas.
Por las particularidades del conflicto interno la conceptualización de la paz en Colombia ha estado enmarcado en negociaciones y acuerdos políticos, sin embargo, su estudio debe estructurarse desde los antecedentes históricos que sobre el concepto se han realizado; por ello este trabajo se centrará en pensar el concepto de paz en Colombia desde un punto de vista teórico y jurisprudencial.
