En el auge de la inteligencia artificial (IA), las máquinas empiezan a imitar e incluso a competir en actividades intelectuales que hasta hace poco tiempo eran consideradas propias de nuestra especie. En el año 2019, fueron presentadas solicitudes de patentes en distintas oficinas del mundo con la intención de que una inteligencia artificial, nombrada “Device for the Autonomous Bootstrapping of Unified Sentience” (DABUS), fuera declarada como inventora. Este artículo tiene como objetivos: brindar un acercamiento a las bases de los desarrollos en IA actuales; recordar algunos conceptos básicos del derecho de patentes; hacer un análisis del caso de DABUS y las conclusiones de distintas oficinas de patentes; revisitar a la figura de la persona jurídica como elemento esencial en las decisiones de las diferentes jurisdicciones en este caso; y exponer algunos escenarios realistas de las consecuencias de incluir o excluir las invenciones generadas con IA de la protección de la propiedad intelectual de cara a debates que ya empiezan a abrirse en la Organización Mundial de la Propiedad Intelectual (OMPI).
