The stiffness of the cardiovascular environment changes during ageing and in disease and contributes to disease incidence and progression. For instance, increased arterial stiffness can lead to atherosclerosis, while stiffening of the heart due to fibrosis can increase the chances of heart failure. Cells can sense the stiffness of the extracellular matrix through integrin adhesions and other mechanosensitive structures and in response to this initiate mechanosignalling pathways that ultimately change the cellular behaviour. Over the past decades, interest in mechanobiology has steadily increased and with this also our understanding of the molecular basis of mechanosensing and transduction. However, much of our knowledge about the mechanisms is derived from studies investigating focal adhesions in non-muscle cells, which are distinct in several regards from the cell-matrix adhesions in cardiomyocytes (costameres) or vascular smooth muscle cells (dense plaques or podosomes). Therefore, we will look here first at the evidence for mechanical sensing in the cardiovascular system, before comparing the different cytoskeletal arrangements and adhesion sites in cardiomyocytes and vascular smooth muscle cells and what is known about mechanical sensing through the various structures.
Les sanctions fiscales font l'objet d'un contrôle constitutionnel dont les principes directeurs ont été progressivement dégagés par le Conseil constitutionnel. Le présent article examine les problèmes constitutionnels encore irrésolus ou qui méritent une nouvelle réflexion. Il s'interroge notamment sur la distinction qu'il convient d'opérer entre sanction et réparation, ainsi qu'entre sanction et impôt. Il propose également certaines réflexions sur les moyens de mieux respecter le principe de légalité des délits et des peines, d'encadrer plus efficacement le pouvoir sanctionnateur de l'administration et de limiter le cumul entre sanctions fiscales et pénales. Pour comprendre la nécessité d'un contrôle constitutionnel des sanctions fiscales, il suffit de partir d'un double constat. Premièrement, les sanctions fiscales sont en nombre très élevé, en dépit du toilettage opéré par l'ordonnance n° 2005-1512 du 7 décembre 2005 (il en existait plus de deux cent avant l'adoption de ce texte) (2). Deuxièmement, leur rendement budgétaire est très substantiel : en 2010, les droits nets réclamés au terme d'un peu moins de 52 000 de contrôles sur place (incluant les vérifications de comptabilité et les examens de situation fiscale personnelle) s'élèvent à environ 7,9 Md i (3), étant précisé que les pénalités additionnelles recouvrées à cette occasion se chiffrent à environ 2,4 Md i. Si l'on compare ces 52 000 procédures administratives au petit millier annuel de procédures pénales au sens strict, il apparaît que la sanction fiscale constitue le moyen privilégié d'inciter les contribuables au respect de leurs obligations fiscales et d'éviter, par ailleurs, le recours au juge pénal. Au vu de cette première approche quantitative du phénomène de la sanction fiscale, il apparaît évident qu'une protection particulière du contribuable s'impose. Mais c'est aussi la nature punitive de la sanction fiscale qui l'exige, nature progressivement reconnue au cours de l'histoire récente (4). L'évolution se fit en plusieurs temps et culmina avec l'affirmation par le Conseil constitutionnel que les principes constitutionnels en matière répressive s'appliquent « à toute sanction ayant le caractère d'une punition même si le législateur a cru devoir laisser le soin de la prononcer à une autorité de nature non judiciaire » (5). Le juge administratif devait alors préciser que les sanctions fiscales ayant un caractère répressif s'entendent de celles qui tendent à empêcher la réitération des agissements qu'elles visent et n'ont pas pour objet la seule réparation d'un préjudice pécuniaire (6). Les sanctions fiscales, sortant de leur sphère d'autonomie, donnaient alors nécessairement prise au contrôle sur la base de l'article 6 de la Convention européenne des droits de l'homme (7). En parallèle, le régime juridique des pénalités fiscales et des mesures de sanction a subi une évolution dans le sens de l'alignement sur celui des sanctions administratives ordinaires.
