Zusammenfassung
Kriminologinnen und Kriminologen sowie Soziologinnen und Soziologen haben in den letzten zwei Jahrzehnten sowohl in der Schweiz wie in Europa umfangreiche Umfragen zu Strafeinstellungen der Bevölkerung und der urteilenden Behörden durchgeführt, ohne dass deren Ergebnisse bisher gesamthaft dargestellt und die Kohärenz der Ergebnisse überprüft worden wäre. Ebenfalls fehlt ein Vergleich dieser Ergebnisse zu den Strafeinstellungen mit Daten der Urteilsstatistik zu den ausgesprochenen Sanktionen, der es erlaubt, der Frage nach einer Übereinstimmung oder Diskrepanz von Vorstellungen und Praxis nachzugehen und diese in einem sozialen Rahmen zu interpretieren. Der vorliegende Artikel untersucht diese Problematik mittels zahlreicher Daten aus Umfragen und offiziellen Justizstatistiken zur Schweiz. Da die in diesem Bericht dargestellten Ergebnisse in die Zeiten zweier Revisionen des Sanktionenrechts (2007 und 2018) fallen, nimmt die Thematik der Bedeutung dieser Revisionen einen zentralen Platz ein.
