Este artigo estuda, a partir do referencial da teoria dos direitos humanos de Amartya Sen, os obstáculos e possibilidades à defesa judicial dos direitos sociais prestacionais. Observa que a realização destes direitos enfrenta três ordens principais de problemas: 1) filosófico, pois teorias de justiça parciais contestam sua fundamentalidade; 2) jurídico-político, uma vez que, por envolver complexas prestações normativas e materiais, assim como argumentos de natureza ética e política, a realização dos direitos sociais prestacionais pela jurisdição poderia violar o princípio da separação dos poderes; 3) processual, porquanto ainda são poucos os instrumentos e as experiências jurisprudenciais voltados à sua efetivação. Conclui-se que, não obstante tais dificuldades, a realização dos direitos sociais prestacionais é possível, desde que se compreenda que os direitos fundamentais são reconhecidos a partir de uma conjugação entre juízos éticos plurais e deliberação democrática. De outra parte, utilizando-se de instrumentos interpretativos, argumentativos e éticos mais amplos, tais como o direito construtivo de Dworkin e a democracia deliberativa de Habermas, bem como o princípio do mínimo existencial, o judiciário estaria apto a defender os direitos sociais prestacionais sem violar o princípio da separação dos poderes. Por fim, tem-se que, valendo-se dos conceitos de mínimo existencial e de meta-direitos, a defesa judicial dos direitos sociais prestacionais pode realizar-se através de alguns instrumentos processuais atuais, desde que devidamente utilizados de acordo o princípio fundamental da tutela jurisdicional efetiva.
O artigo rediscute, a partir das teorias da hegemonia de Chantal Mouffe e dos diálogos institucionais de Mark Tushnet, os fenômenos da judicialização da política (o político invadindo “indevidamente” o jurídico) e do ativismo judicial (o jurídico invadindo “indevidamente” o político). Contesta a concepção usual de que o judiciário teria a “ última palavra” na interpretação jurídica e defende uma maior proteção da democracia, pois é esta, não o judiciário, que, em última instância, protege os direitos. Conclui-se que, para sua maior legitimidade e eficiência, deve então o Poder Judiciário receber novos influxos democráticos e estar sujeito a maior accountability.
O artigo buscou examinar os vínculos entre acesso à justiça e a efetividade de um dos aspectos do direito à saúde no Brasil, o acesso a medicamentos, a partir dos votos dos ministros do Supremo Tribunal Federal no Recurso Extraordinário nº 566.741/RN e à luz da compreensão e aplicação das teorias dos diálogos institucionais pela Suprema Corte. Discutiu-se que, de maneira geral, há apenas uma enunciação retórica das teorias dos diálogos institucionais (que valorizam, em regra, as capacidades institucionais de cada Poder e a autocontenção do Poder Judiciário) sem de fato aplicá-la. Nesse sentido é representativo o voto do ministro Luís Roberto Barroso, o qual, apesar de expressamente enunciar a aplicação das teorias dos diálogos, não as aplica para resolver o problema da usurpação das funções da Comissão Nacional de Incorporação de Tecnologias no SUS (CONITEC) pelo Poder Judiciário através dos Núcleos de Apoio Técnico ao Judiciário (NatJus), perpetuando a dissolução do direito constitucional a políticas públicas de saúde em um mero direito subjetivo a medicamentos. Concluiu-se que uma possível e definitiva solução dessa questão passa pelo aperfeiçoamento do accountability sobre o Poder Judiciário, de modo que, entre outras coisas, possa ampliar o compartilhamento das consequências políticas e econômicas de suas decisões com a sociedade.
O objetivo do presente ensaio é especular as razões pelas quais a literatura jurídica sanitária não se debruçou de maneira incisiva sobre as causas mais remotas do fenômeno da judicialização da saúde e como isso se relaciona diretamente com a crise democrática atual. Afirma-se que o conceito de democracia sustentado pela doutrina jurídica sanitária é uma derivação do conceito idealizado de democracia do liberalismo, porquanto ingenuamente subestima a degeneração da democracia em lobby e ignora os estudos empíricos da ciência política contemporânea que apontam o desinteresse e a passionalidade dos cidadãos com relação aos assuntos públicos. Além disso, ao exaltar um suposto exercício democrático via demandas judiciais de saúde, a doutrina jurídica sanitária dá pouca atenção a explicações alternativas sobre a origem da judicialização da política, tal como a oferecida por Ran Hirschl, o qual sustenta que a crescente judicialização (juristrocracia) nasce de um acordo estratégico entre as elites econômica, política e jurídica para a preservação hegemônica de seus interesses e para o avanço de uma agenda econômica neoliberal. Sustenta-se a hipótese de que a omissão da doutrina jurídica sanitária para com explicações mais profundas acerca da judicialização da política está relacionada exatamente com esta preservação de interesses da elite jurídica. Por tal razão, para se avançar no aperfeiçoamento da democracia, há que se refletir acerca das causas estruturais da judicialização, e assim promover reformas institucionais que mitiguem tanto a influência do poder econômico na política quanto os mecanismos de produção de ativismo judicial.
