The BRICS countries have aspirations to achieve sustainable development in their economies and environmental protection. These aspirations have an important social aspect in the area of employment protection as it relates to ensuring fair development. In order to establish national standards for dismissal protection in four of the BRICS countries (Brazil, Russia, China and South Africa) the authors have considered the legislation and relevant national case law. This paper includes a review of International Labour Organisation (ILO) standards of dismissal protection, which are used as a pattern for comparison. The paper consists of five parts: the first deals with the history and explores the legal standards adopted in the ILO Convention No. 158; the remaining four parts present the research on each of the national dismissal protection systems in the four BRICS countries under study. The authors conclude that even though the national systems are different and have dissimilar scopes in respect of dismissal protection, their regulations are largely in line with the Convention, which has not been ratified by any of the BRICS countries; and that international instruments even without ratification may be a helpful instrument for shaping the national system of dismissal protection, and for providing guidance to policymakers and legislators.

Discussão: A percepção sobre o serviço, inicia a partir do momento do ingresso do médico do trabalho por concurso público em outubro de 2018 até janeiro de 2019. O método de análise de percepção utilizado foi através de questionário, entrevista e livre dissertação pelo médico do trabalho, que tem carga horária de 20 h/semanais, regime CLT, onde realiza serviços e exames médicos ocupacionais, responde pareceres técnicos, faz análise de laudos periciais, relativos à questões jurídicas, acompanha perícias médicas, também é responsável por gestão de absenteísmo. No início do trabalho, foi detectado dificuldade na organização, pois não se identificava o motivo do atendimento, por indicação do próprio médico, foi implantado um guia de encaminhamento interno, com isso pode haver uma otimização no atendimento. A percepção de estresse do médico é elevada, devido peculiaridades como acordos coletivos, manuais de condutas próprias da empresa e casos complexos. Comentários Finais: O SESMT desta empresa tem suas peculiaridades, deficiências, embargos, porém com alto potencial para se tornar referência, o que demandará investimento em conhecimento técnico e gestão. Para o médico há necessidade de realizar cursos relativos às áreas de ortopedia ocupacional, psiquiatria ocupacional e gestão de absenteísmo. Há ainda a necessidade de uma melhora na área da Tecnologia de informação, para traçar estratégias de comunicação dinâmica, prática e segura.
O objetivo deste artigo foi o de identificar os motivos da judicialização do acidente de trabalho, discutindo os possíveis efeitos que a unificação de competências jurisdicionais teria sobre a judicialização do acidente de trabalho. A pergunta que norteou esta pesquisa foi: Qual o índice de ações acidentárias de aposentadoria por invalidez e auxílio-doença impetradas em face do Instituto Nacional de Seguridade Social julgadas pelas 16º e 17ª Câmaras de Direito Público do Tribunal de Justiça de São Paulo nos anos de 2017 e 2018 que tiveram em algum momento trâmite pela Justiça Federal e como como tal índice se relaciona com os princípios de maior celeridade e da devida prestação jurisdicional diante da não unificação das competências? A hipótese de que uma minoria processos julgados no período indicado pelas Câmaras teve trâmite pela Justiça Federal foi confirmada, diante da tramitação pela Justiça Federal de 8% dos processos julgados em segunda instância pelo TJSP, o que equivale a 242 processos. Tais processos por tramitarem em justiças distintas tiveram maior duração temporal quando comparado aos similares de tramitação exclusiva por competência estadual, reduzindo a efetividade da prestação jurisdicional, o que teria sido evitado com a unificação de competências. Para tanto, foram analisados 3.123 acórdãos julgados pelo TJSP, por meio dos da análise de decisões, consistente na coleta dos acórdãos proferidos pelos julgadores das 16ª e 17ª Câmaras de Direito Público, que têm competência específica para julgar apenas as lides acidentárias nos anos de 2017 e 2018.
This article investigates the phenomenon of gender equality in employment in the BRICS countries where it is one of the factors hampering the economic development and basic human rights. The authors examine the international obligations of these states under the human rights treaties of the United Nations Organization (UNO) and the International Labour Organization (ILO), compare the national anti-discriminatory norms with the international standards (ILO Conventions and the Convention on the Elimination of all Forms of Discrimination Against Women) and evaluate the observations of the relevant international bodies recently adopted in respect of the BRICS states. In particular, the activities of the Committee on the Elimination of Discrimination Against Women and the ILO Committee of Experts on the Application of Conventions and Recommendations are reviewed. In the paragraphs that follow, the national legislation and case-laws are examined. Furthermore, the reasons for the persistent gender stereotypes in the labor market, as well as the general attitude toward women’s roles in society in each country are reviewed. The authors identify the obstacles to achieving true gender equality in the workplace and formulate recommendations for improving protections against discrimination of women in employment as well as ensuring equal access to employment and promotion.
O estudo delineou o posicionamento do Pleno do Supremo Tribunal Federal (STF) no período de 2006 a 2016 no tocante ao Benefício Assistencial de Prestação Continuada (BPC). O foco da pesquisa foram a interpretação e o alcance dados pelo STF ao artigo 20 da Lei nº 8.742/1993, conhecida como Lei Orgânica de Assistência Social (LOAS) e como o Plenário da Corte Constitucional solucionou a tensão existente entre a efetivação dos direitos sociais, a tese da reserva do possível e o recorte de renda imposto como critério de elegibilidade ao benefício previsto pela LOAS.A metodologia utilizada foi à descritiva, realizando-se análise documental, por meio do estudo dos acórdãos proferidos pelo plenário do STF.Os resultados encontrados indicam a existência de 08 acórdãos acerca do tema, que permitiram concluir que o STF solucionou a tensão existente entre a efetivação dos direitos sociais e a tese da reserva do possível, ao considerar que o recorte de renda imposto como critério de elegibilidade ao benefício previsto pela LOAS é inconstitucional incider tantum, sem declaração de nulidade, e que devem prevalecer o princípio da dignidade da pessoa humana e os objetivos da Lei Maior sobre a tese da reserva do possível. 10.12957/rfd.2020.32799
This paper follows the idea of Amartya Sen, Nobel Prize of economic, about the role of State in the assurance of minimal existence condition, and aim to answer how countries of Latin America (specifically Brazil) and countries of Europe (specifically United Kingdom) deal with the assurance of this minimal existence conditions.According to Amartya Sen's view, development must be seen as a process of expanding substantive freedoms, such expansion being the primary purpose of each society and the main mean of development.Substantive freedoms can be considered as basic capabilities allocated to individuals whereby they are entitled to be architects of their own lives, providing them conditions to "live as they wish".These basic capabilities are divided by Amartya Sen in 5 (five) kinds of substantive freedoms, but for this article's purpose, we will consider just one of this 5 (five) kinds, specifically the Protective Safety capability.Protective Safety capability may be defined as the assurance of basic means of survival for individuals who are in extreme poverty, at risk of starvation or hypothermia, or even impending famine. Among the means available that could be used to avoid such situations are the possibility of supplemental income to the needy, distributing food and clothing to the needy, supply of energy and water, among others.But how countries deal whit this protective safety? Aiming to answer this question, we selected the problem of "fuel poverty" and how Brazil and United Kingdom solve it (if they solve), in order to assess how the solution found impacts development. The analysis and the comparison between these countries will allow an answer to the question proposed.
