Nicht häufig, aber mit einer gewissen Regelmäßigkeit werden Urologen, Gynäkologen oder andere chirurgisch tätige Kolleginnen und Kollegen mit der Bitte nach Sterilisation geistig behinderter Menschen konfrontiert. Da es sich um ein relativ selten auftretendes Ereignis handelt und auch die Gruppe dieser Patienten hinsichtlich Ihrer Behinderung sehr heterogen ist, sollte der oder dem Behandelnden die aktuelle Rechtslage bekannt sein, da nicht immer die zumeist vorliegende Einverständniserklärung des Vormundes zur Durchführung der Sterilisation berechtigt. HistorieNach dem Untergang des Nationalsozialismus wurde das "Gesetz zur Verhütung erbkranken Nachwuchses (14. Juli 1933; RGBI I S.529)" durch eine in den einzelnen Bundesländern unterschiedliche Rechtslage ersetzt. Grundlage dieser verschiedenen Rechtsauslegungen waren generelle Normen in Gebotsform, die selbst keine strafrechtliche Bedeutung besaßen. Bestimmt wurden diese Normen durch die Interessen des Staates (Erhaltung des quantitativen Bevölkerungsstandes), ständischer Organisationen (z.B. Ärzteschaft; Erhaltung der physiologischen Fruchtbarkeit) und der religiösen Glaubensgemeinschaften (Erhaltung einer Sexualmoral). Diese Normen, auch als "Humanismus des Menschen, wie er sein soll" bezeichnet, wurden dann im 20. Jahrhundert durch den "Humanismus des Menschen, wie er ist" abgelöst (10). Diese Wendung spiegelt sich in den so genannten "Dohrn-Prozessen" wider (Dr. Dohrn hatte zwischen 1946-61 ca. 2000 Frauen aufgrund sozialer Indikationen sterilisiert, er wurde in 149 Fällen angeklagt und in 40 Fällen verurteilt. Das Urteil wurde durch den Bundesgerichtshof wieder aufgehoben). Weitere Versuche einer Strafrechtsreform, die den Schwangerschaftsabbruch und die Sterilisation regeln sollten, wurden nur in Richtung der Regelung des Schwangerschaftsabbruchs weiter entwickelt. Anstelle einer strafrechtlichen Regelung der Indikationsstellung trat die zivilrechtliche Haftung des Arztes für den Eingriff selbst. Diese Neuregelung ist im "Gesetz zur Reform des Rechts der Vormundschaft und Pflegschaft für Volljährige", das am 12. September 1990 und am 1. Januar 1992 in Kraft trat, verankert. Allgemeines zur Aufklärung von behinderten MenschenJeder operative Eingriff erfüllt rechtlich den Tatbestand der Körperverletzung. Sofern jedoch ein "Rechtfertigungsgrund" vorliegt, besteht Straffreiheit für den Behandelnden. Im Verhältnis Behandler/ Patient ist der am häufigsten vorkommende Rechtfertigungsgrund die Einwilligung des Patienten. Diese setzt jedoch zwingend voraus, dass der Patient über die Art, mögliche Folgen, Konsequenzen einer Nichtbehandlung sowie alle denkbaren Komplikationen vor dem eigentlichen Eingriff aufgeklärt wurde. Die Aufklärung von Patienten nimmt im klinischen Alltag einen großen Raum ein. Die Art und der Umfang einer Aufklärung für einen operativen Eingriff wird im juristischen Sinne unter dem Begriff der "Selbstbestimmungsaufklärung" festgelegt.
