Up to now informative studies have not reliably shown that the effect of ambulatory health education programmes for overweight and obese children and adolescents and their parents may last for more than one or two years. Therefore, a controlled clinical trial determining the long-term effectiveness of such programme is imperative. The decision whether a defined programmes should be included in such a study could be taken on the basis of the quality indicators and assessment criteria described here.
Das Gesetz zum Schutz der erwerbstätigen Mutter (Mutterschutzgesetz -MuSchG) besteht seit dem Jahr 1952 und wurde nach einer grundsätzlichen Novellierung 1980 und mehrfachen Änderungen zuletzt 1997 geändert (BGBl I, S. 22, 293). Das Mutterschutzgesetz soll die berufstätige Frau und ihr Kind während der Schwangerschaft und nach der Entbindung vor Gesundheitsschäden bewahren, bessere Bedingungen für die Betreuung von Säuglingen und Kleinkindern schaffen und die Frauen vor finanziellen Einbußen schützen. Das Mutterschutzgesetz kann von allen Frauen in Anspruch genommen werden, die sich in Deutschland in einem Arbeits-oder beruflichen Ausbildungsverhältnis befinden oder in einem privaten Haushalt beschäftigt sind. Für Beamtinnen gilt die Mutterschutzverordnung (Verordnung über den Schutz von Beamtinnen vom 25.04.1997, BGBl I, S. 986), die ihnen die gleichen Rechte zusichert.Damit Schwangere die Erleichterungen durch den Mutterschutz in Anspruch nehmen können, empfiehlt es sich, dass sie ihrem Arbeitgeber die Schwangerschaft und den mutmaßlichen Tag der Entbindung mitteilen, sobald ihnen ihr Zustand bekannt ist ( § 5 Abs. 1 Satz 1 MuSchG). Damit wird keine Rechtspflicht für die werdende Mutter begründet, sondern nur eine nachdrückliche ᭤ Empfehlung im Interesse der Schwangeren und des Kindes ausgesprochen, da der Arbeitgeber ohne Kenntnis der bestehenden Schwangerschaft keine Schutzvorschriften beachten kann. Der Arbeitgeber darf außer an das Gewerbeaufsichtsamt und den Betriebs-oder Personalrat die Mitteilung der Schwangeren an niemanden weitergeben. Hat der Arbeitgeber Kenntnis von der Schwangerschaft, kann er von der werdenden Mutter das schriftliche Zeugnis eines approbierten Arztes oder einer staatlich zugelassenen Hebamme über die bestehende Schwangerschaft und den mutmaßlichen Tag der Entbindung verlangen. Die Kosten dafür trägt der Arbeitgeber nur, wenn es auf sein Verlangen hin ausgestellt ist ( § 5 Abs. 3 MuSchG).Die Frage nach einer bestehenden oder vermuteten Schwangerschaft im Rahmen von ᭤ Einstellungsverhandlungen wird von der Rechtsprechung nur ausnahmsweise als zulässig angesehen, nämlich in den Fällen, in denen die Frage objektiv dem Gesundheitsschutz von Mutter und Kind dient (Einstellung einer Arzthelferin, die mit infektiösen Laborproben umzugehen hat) oder das Arbeitsverhältnis nicht realisiert werden kann (z.B. Concepts for prevention in the long-term care for old and very old people have been implemented quite successfully in several states. In order to employ similar programmes in Germany one should refer to available international experience. This should be combined with the former experiences in Germany itself.
