Dabei erscheint mir dieser Ansatz, dessen Wurzeln in der Durkheim'schen Straftheorie zu suchen sind, ein viel geeigneterer Kandidat für den erforderlichen "Elastizitätstest". Mit ihm lassen sich nämlich unschwer unterschiedliche Margen für kulturelle Relativierungen verbinden. Denn es geht dabei ja nicht nur um die Verdeutlichung einzelner konkreter Strafnormen, sondern allgemein um die Durchsetzungskraft des Staates bei der Gewährleistung der Durkheim'schen "cohésion sociale". 64
V. SchlussbetrachtungPatentlösungen gibt es nicht für unsere Problemstellungen. Sie können namentlich nicht darin liegen, für alles und jedes eine "cultural defense" zu begründen. Strafrechtliche Standards sind eben nicht immer deckungsgleich mit persönlichen Überzeugungen. Die strafrechtlichen Standards sind Ausdruck des normativen Konsenses der jeweiligen Gesellschaft. In einer demokratisch organisieren Gesellschaft hat der Gesetzgebervorbehaltlich einer Kontrolle durch die Verfassungsgerichtedas letzte Wort im Konflikt rivalisierender Positionen. Gesetzgebungsprozesse sollten natürlich so angelegt sein, dass sich Minderheiten zur Geltung bringen können. Ist das Strafgesetz in Kraft, kann der Gesetzgeber keine Verstöße unter Berufung auf eine abweichende persönliche Überzeugung mehr dulden. Entschuldigungsgrund, Strafmilderung oder Einstellung wegen geringer Schuld sind die Optionen, wenn das Motiv akzeptabel ist. Was akzeptabel ist, lässt sich vor dem Hintergrund der verfassungsrechtlichen Bewertungsvorgaben einigermaßen verlässlich feststellen. 65 Wir können bei der ganzen Diskussion zwar an vertraute strafrechtsdogmatische Kategorien anknüpfen, angesichts der dynamischen Entwicklung stellt sich der Pluralismus jedoch als ein in dieser Form neuartiger Prüfstein für Strafrecht und Straftheorie dar: Kollidierende Gruppennormen sind im Zeitalter der Globalisierung zu einem ubiquitären Phänomen geworden. Sollten wir wieder dazu kommen, dass jeder sein Recht mit sich trägt, wo sich doch im Strafrecht gerade erst das Territorialitätsprinzip durchgesetzt hat? Wir wissen nicht so recht, wie sich die Pluralismusdebatte in die sich verstärkende Diskussion über die "innere Fragmentierung" der Rechtsordnungen einordnet. Wir ahnen, dass die Marge an Toleranz und damit an Elastizität der Strafrechtsordnung in Relation zur Selbstsicherheit eines Gemeinwesens steht. Gemeinwesen, die von allzu vielen Selbstzweifeln angekränkelt sind, werden dahin tendieren, die Reihen zu schließen, und zwar auch mit den Mitteln des Strafrechts. Man darf dies natürlich nicht statisch sehen; hier sind auch Entwicklungsprozesse denkbarsiehe die Niederlande, wo die viel gerühmte breite Marge der Toleranz 66 längst im Schwinden begriffen ist.Der Begriff der "cultural defense" hat einen verlockend permissiven touch in einer Zeit, die eher durch Punitivität gekennzeichnet ist. Providing a comprehensive review of the recent developments in migration and refugee law proves to be an impossible undertaking – one reason being the vast diversity of this area of law, which includes asylum, work or family migration, the other being the mix of actors in the multi-level system. The events of 2015, which are more likely to be referred to as “refugee protection crises” rather than a “refugee crisis”, undoubtedly mark a turning point. They have not only revealed the shortcomings of the Common EU Asylum System, but have triggered a broad societal debate on immigration as such. The focus of the following report will be on refugee law. First, the supra-national aspects of this increasingly Europeanized area of law shall be determined. Furthermore, the recent and various changes in national law shall be analyzed, ranging from the acceleration of asylum procedures, the efforts to limit and control migration up to the establishment of socio-economic incentive structures in order to avoid “bogus” asylum procedures. Finally, the article provides an overview of the perspectives of European and national migration and refugee law.
