The principle of autonomy was a significant bioethical achievement in terms of its positive impact on the physician-patient relationship. The search for balance in the paternalistic doctor and indigenous patient relationship is fundamental for the symmetrical maintenance of such relations. In this context, it is essential that the medical professional considers and accepts the existence of social and cultural diversity when planning therapeutic strategies that aim to ensure the autonomy of the patient, the family and community, thus guaranteeing a good quality of service and of life. The aim of this article is to characterize, from the perspective of bioethics, the challenge faced by the physician-indigenous patient relationship, indicate critical situations and suggest means for an ideally harmonious relationship between these cultures in the area of health. Diante disso, é indispensável que o médico considere e admita a existência da diversidade social e cultural para elaborar projetos terapêuticos que visem a autonomia do paciente, da família e comunidade, garantindo, assim, bom atendimento e qualidade de vida. Consentimento informado é o registro em prontuário de uma decisão voluntária, por parte do paciente ou de seus responsáveis legais, tomada após um processo informativo e esclarecedor, para autorizar um tratamento ou procedimento médico específico, consciente de seus riscos, benefícios e possíveis consequências. Deve documentar que o paciente foi informado a respeito das opções de tratamento, se existirem.Há diversas denominações usadas, em nosso meio, para se referir ao consentimento informado: "ciên-cia e consentimento", "consentimento após informação", "consentimento livre e esclarecido", "consentimento pós-informação", "formulário de autorização de tratamento", "termo de aceitação do tratamento médico-cirúrgico ambulatorial", "termo de consentimento esclarecido", "termo de consentimento informado", "termo de esclarecimento e consentimento", "termo de esclarecimentos" e até o termo em inglês "informed consent" (1) . O bom atendimento médico, mesmo quando o desfecho é desfavorável, depende da empatia entre a equipe de saúde e o paciente e sua família. Fazer coincidir expectativas é um dos objetivos a alcançar nesse processo e, para tanto, a troca de informações entre as partes envolvidas é fundamental. O profissional de saúde obtém as informações de que necessita por meio de adequadas técnicas propedêuticas, das quais a anamnese é imprescindível. Por parte do paciente e sua família, as informações amplas e detalhadas que o profissional da saúde é capaz de transmitir a respeito da doença são instrumentos imprescindíveis.Para participar das decisões sobre sua saúde, o paciente ou seus responsáveis legais precisam ser esclarecidos sobre a enfermidade, seu prognóstico, a necessidade de exames complementares e de procedimentos e as opções terapêuticas com seus riscos, benefícios e custos (2) . Essas informações devem ser abrangentes e em termos que possam ser entendidos pelo paciente ou por seus responsáveis legais.Documentar que tais informações foram transmitidas e compreendidas é o espírito do consentimento informado. Ele expressa o respeito ao direito do paciente ou seus responsáveis legais de decidir, de modo esclarecido, a respeito de qualquer ato praticado para fins de diagnósti-co e tratamento da doença. Nessa documentação, é importante assinalar que, havendo o consentimento, este pode ser revogado a qualquer momento.É dever do médico recomendar a conduta que considera a mais adequada, baseada nas melhores evidências disponíveis, mas respeitando o direito do paciente e de seus responsáveis legais de escolherem livremente as que mais lhes convêm ao considerar seus próprios valores religiosos, espirituais, morais, éticos e culturais. Tal dever tem também implicações jurídicas nas esferas administrativa, cível e penal. Consentimento informado não é, portanto, mera formalidade para comprovar qualidade de atendimento por parte de instituições de acreditação hospitalar.Algumas situações, entretanto, complicam tal processo. BACKGROUND: Nowadays, there is an ethical and moral necessity to establish rules that govern professional attitudes and conduct. In the medical field, these rules are multifaceted, given the health consequences inherent to medical procedures. Ethics is an even more delicate subject when it comes to plastic surgery, since one of the aims of this particular medical specialty is esthetic improvement of the body. OBJECTIVE: To survey and classify São Paulo State Medical Board investigations of plastic-surgery complaints that were treated as professional-misconduct cases between 2007 and 2016. DESIGN AND SETTING: Cross-sectional study conducted in a medical council. METHODS: A total of 360 cases were reviewed. Among these, 8 (2.23%) were dismissed, 1 (0.27%) became an administrative lawsuit and 351 (97.50%) were treated as professional-misconduct cases. RESULTS: A breakdown of the complaints filed over the nine-year period showed that complaints concerning malpractice were the most common (28.43%), followed by those regarding medical advertising (24.19%) and poor doctor-patient relationships (10.39%). CONCLUSION: Overall, the number of complaints lodged decreased over the last two years reviewed, although complaints regarding malpractice and poor doctor-patient relationships increased by 10% over the same period. The Guidelines Project, an initiative of the Brazilian Medical Association, aims to combine information from the medical field to standardize how to conduct, and to assist in the reasoning and decision-making of doctors. The information provided by this project must be critically evaluated by the physician responsible for the conduct that will be adopted, depending on the conditions and the clinical condition of each patient.
BACKGROUND: In plastic surgery, a lack of ethical and moral behavior by professionals can result in unfortunate circumstances and can justify ethical-disciplinary procedures. OBJECTIVE: To review 421 plastic surgery professional-misconduct cases filed before the São Paulo State Medical Board (CREMESP) between 2008 and 2017. DESIGN AND SETTING: Cross-sectional study conducted in a medical council. METHODS: The cases were categorized according to sex, age, medical specialty (plastic surgery, other field or none), medical ethics code chapter(s) involved, ethics code articles violated and board ruling/outcome. RESULTS: Most of the defendants were men over 40 years of age who were experienced in their professional practice and who graduated from public and private universities all over Brazil; 47.74% had a specialist title in plastic surgery. Violation of professional responsibility (medical malpractice, recklessness or negligence) was the commonest complaint (28.43%), followed by medical advertising (24.19%) and poor doctor-patient relationship (10.39%), in violation of articles 18, 51, 75 and 1. Among the 233 cases adjudicated over this period, 133 resulted in disciplinary sanction, 80 were ruled in the physician's favor and 20 were dismissed. CONCLUSION: Classification of plastic surgery professional-misconduct cases creates possibilities for adopting preventive measures for good practice in this specialty, which would consequently reduce the number of complaints to the regional medical boards.
