El sistema jurídico de los Estados se construye sobre la base de los usos y costumbres de la población; no obstante, en el sistema jurídico peruano se impone la tradición greco-romana, que conduce a la clandestinidad al derecho de costumbre. El objetivo de esta investigación es evidenciar la naturaleza de la formación académica del derecho en las universidades públicas y privadas del Perú mediante el análisis de los currículos de estudios. Se utilizó como método la revisión documental de información disponible en la página web de la Superintendencia Nacional de Educación Superior Universitaria - SUNEDU. De acuerdo con los resultados, en el Perú, de las Facultades que forman profesionales en derecho 29.8% corresponde a universidades públicas y 70.2% a privadas. De ellas, 70.24% establecen que la materia de Derecho romano y Derecho anglosajón son de carácter obligatorio, mientras que 71.4% no consideran cursos referidos al pluralismo jurídico o derecho consuetudinario. Por lo tanto, la formación profesional en derecho y por ende, la administración de justicia no va acorde con el contexto. En los últimos años se han desencadenado graves crisis y conflictos sociales con trasfondos de inequidades culturales. Por lo cual se debe considerar el derecho consuetudinario andino como materia relevante en la formación universitaria peruana de los futuros abogados que impartirán justicia en una población que se autoidentifica como indígena.
El presente artículo analiza la administración pública de corte tradicional burocrático: las debilidades en cuanto a sus instrumentos de evaluación, los resultados poco favorables para los usuarios del servicio público y la carencia de instrumentos suficientes para una adecuada valoración, a la vez que explora la posibilidad de modificación de esta realidad. El análisis lleva a plantear la urgente necesidad de construir e implementar indicadores conmensurables, que permita medir los logros de la gestión, identificar las debilidades para plantear alternativas de potenciación o de solución, haciendo una gestión más cercana al usuario. La metodología utilizada fue el cualitativo exploratorio de revisión documentaria, a partir de la cual se plantean posibilidades de construcción de indicadores adecuados a una organización para una mejor gestión. La conclusión fundamental es que toda acción gubernamental debe brindar un óptimo servicio.
Las reacciones emocionales de los niños indígenas requieren ser abordadas desde un enfoque de salud intercultural, debido a que son motivadas por patrones culturales que difieren del sistema hospitalario. El objetivo es interpretar las reacciones emocionales de los niños indígenas en hospitalización. Metodología, enfoque cualitativo de tipo etnográfico interpretativo, realizado en un hospital público con 23 niños hospitalizados en el área de pediatría, por medio de entrevistas a profundidad. Los resultados reflejan la incomprensión de los códigos culturales, temor al abandono, rebeldía a las indicaciones del personal de salud, temor a los procedimientos y trastornos del sueño. Arribamos a la conclusión de que el niño hospitalizado aymara y quechua, por el contexto cultural de procedencia, se enfrenta a una relación desventajosa en el hospital, expresado en la incomprensión de códigos hospitalarios de parte de los niños y códigos culturales de parte del personal de salud. Por tal motivo, es fundamental reconocer la diversidad cultural, étnica y multilingüismo de los pacientes durante la atención especializada.
