ResumoEm 18 de março de 2016, um novo Código de Processo Civil passará a viger no Brasil, trazendo diversas inovações normativas, dentre as quais se destacam algumas poucas modificações no procedimento das ações possessórias para conflitos fundiários coletivos. As instituições e movimentos sociais ligados à causa da Reforma Urbana, depois de grande mobilização durante o processo legislativo do novo Código, não conseguiram transformar em leis a maior parte de suas demandas, e vêm o aludido texto legal como fruto de uma vitória conservadora. Resta ao presente estudo analisar as suas principais modificações normativas, avaliando se elas serão realmente capazes de enfrentar o grave problema de habitação que marca a evolução histórica da maioria das cidades brasileiras. Objetiva-se, com isso, enriquecer o debate sobre a efetivação do direito à moradia, seja no âmbito local, seja no internacional, já que 2016 também é o ano da Habitat 3, a Terceira Conferência das Nações Unidas sobre Moradia e Desenvolvimento Urbano Sustentável. AbstractOn March 18, 2016, a new Civil Procedure Code will come into effect in Brazil, bringing several regulatory innovations, among which stand out a few changes in the procedure of possessory action to collective land conflicts. Institutions and social movements linked to the cause of Urban Reform, after massive mobilization during the legislative process of the new Code, failed to turn into laws most of their demands, and come the aforementioned legal text as the result of a conservative victory. It remains to this study to analyze its main legislative changes, assessing whether they will actually be able to address the serious housing problem which marks the historical evolution of most Brazilian cities. The objective is to thereby enrich the debate on the realization of the right to housing, either locally, or in the international since 2016 is also the year of Habitat 3, the Third United Nations Conference on Housing and Sustainable Urban Development.
O presente artigo propõe uma análise do Direito à Cidade no âmbito da mobilidade urbana das grandes e médias cidades brasileiras. Partiremos da premissa de que o ambiente urbano se revela enquanto palco da luta de classes, onde o poder público escamoteia os direitos e garantias fundamentais da classe trabalhadora, comprometendo, também, a locomoção democrática nas urbes. Tal posicionamento permitirá conjecturar sobre a influência do grande capital nos processos de urbanização e reestruturação urbana, que, a princípio, visam garantir o lucro nos mercados automobilístico e imobiliário em detrimento danecessária construção de um sistema de transportes que atenda a universalidade de maneira sustentável. Neste sentido, observaremos como o Plano Nacional de Mobilidade Urbana, instituído pela lei 12.587, de 3 de janeiro de 2012, pretende amenizar a referida disputa, reclamando para o meio urbano um projeto favorável á classe trabalhadora e contrário às tendências hegemônicas. Pleiteamos, assim, contribuir para a construção dos estudos do direito à cidade no âmbito da mobilidade urbana, analisando a necessidade de uma reestruturação a partir da perspectiva universal e sustentável.
A mora do Poder Executivo Federal na demarcação de terras indígenas tem acarretado em recorrente intervenção do Poder Judiciário, ensejando no fenômeno da judicialização dos processos demarcatórios, que apesar de não ser recente, foi intensificado com a fixação da tese do marco temporal após o julgamento da Petição n. 3.388/RR, pelo Supremo Tribunal Federal. A utilização da referida tese afetou a garantia constitucional do direito originário dos povos indígenas sobre os territórios que tradicionalmente ocupam, previsto na Constituição de 1988, uma vez que passou a ser utilizada como fundamento em ações judiciais para anular demarcação de terras já concluídas e para negar o reconhecimento ao direito territorial. Diante disso, o presente trabalho tem como objetivo realizar uma análise sobre a constitucionalidade e os efeitos da utilização da tese do marco temporal na judicialização dos processos administrativos de demarcação de terras indígenas no Brasil.
ResumoMesmo antes de sua realização, os Jogos Olímpicos Rio 2016 têm trazido diversas contradições e ambiguidades a sua cidade sede. Enquanto as promessas de legados grandiosos são repercutidas desde o dia em que o referido megaevento esportivo foi anunciado, o Rio de Janeiro tem se tornado um palco de privatização do espaço urbano e de segregação sócio-espacial. O presente estudo procura estabelecer o quanto essa lógica elitizadora e espoliadora de produção da cidade acaba influenciando a criação de legislações de exceção que eclipsam conquistas legislativas, e como a política urbana relacionada ao Direito à Cidade acaba sendo suprimida nesse contexto de megaeventos.Palavras-chave: Jogos Olímpicos Rio 2016. AbstractEven before its completion, the Rio 2016 Olympic Games have brought many contradictions and ambiguities to their host city. While the promises of magnificent legacies are passed since the day that mega sports event was announced, Rio de Janeiro has become an urban space of privatization and socio-spatial segregation. This study seeks to establish how this predatory logic of production and city gentrification eventually influenced the production of exception laws that eclipse legislative achievements, and how urban policy related to the Right to the City ends up being suppressed in this context of mega-events.
Este trabalho constitui-se enquanto um estudo de caso acerca de duas ocupações urbanas na cidade de Vitória da Conquista/BA: a ocupação “Comunidade Maravilhosinha” e a ocupação “Cidade Bonita”, localizadas em zonas periféricas da cidade. Busca-se analisar, a partir destas ocupações, o modelo de (re)produção desigual do espaço urbano e as soluções adotadas pelo Poder Público à luz das legislações pertinentes (Estatuto da Cidade, Constituição da República e Plano Diretor Urbano de Vitória da Conquista). Discute-se, ainda, no caso da ocupação “Cidade Bonita”, os limites de atuação municipal em conflito aparente entre o direito à moradia adequada e o direito ao meio ambiente sustentável.
