Resumo: A tipicidade é a condição para que o método penal se desenvolva e possibilite, em face das exigências da Legalidade Penal, a avaliação dogmática da imposição de uma pena. Ocorre que pela necessidade do uso da linguagem para a realização desse juízo, desvela-se uma crise, que é falsamente tratada a partir de um silogismo. Nesse panorama, põe-se em relevo o papel do entimema no método penal, que possibilita a própria crítica do sistema de dogmática do crime e descortina os caminhos para a interpretação desse ramo do direito.
O presente estudo trata de análise dos argumentos majoritários e minoritários que nortearam os Ministros do Supremo Tribunal Federal no julgamento do RHC 163334/SC, por meio do qual se criminalizou o não recolhimento de ICMS próprio e declarado. Para além disso, este trabalho se propõe a abordar importantes críticas à tese firmada pelo Plenário, assim como a apresentar alguns parâmetros interpretativos que servirão para nortear uma aplicação mais adequada e coesa da tese firmada. Para tanto, adotou-se a metodologia de análise de jurisprudência, especificamente, dos votos dos Ministros do STF no RHC 163334/SC, bem como dos votos proferidos no HC 399.109/SC, pelos Ministros do STJ, que firmaram igual entendimento. Ademais, adotou-se a metodologia de revisão bibliográfica de doutrinas e artigos que abordam a decisão objeto do presente trabalho, e que tratam dos crimes contra a ordem tributária de forma mais ampla. Importante apontar que o presente trabalho não objetiva esgotar a controvérsia que circunda a temática objeto RHC 163334, mas busca propor caminhos para uma aplicação da nova tese que seja mais condizente com o ordenamento jurídico brasileiro e especialmente com o Direito Penal.
A norma penal é o imperativo que nasce da síntese entre o tipo e o bem jurídico. Este imperativo, criado na época do idealismo alemão, é fundamental para o método penal, pois está na estrutura dos elementos do crime. A investigação da norma e do seu valor correspondente é o objeto da presente pesquisa.
