Cette recherche se situe au croisement de la sociologie de l’action publique, de la sociologie des relations professionnelles et de la sociologie économique. Elle montre l’introduction et l’institutionnalisation de formes de concurrence au cœur du SPE en dépit de l’échec à démontrer l’efficacité supérieure des opérateurs privés par rapport à l’opérateur public. Les violents désaccords qui apparaissent autour des marchés de recours aux OPP éclairent les conflits de régulation du SPE dont les termes se modifient avec les évolutions de l’architecture institutionnelle. Avant la fusion (2008), le recours aux OPP est une arme de l’institution paritaire contre l’opérateur public (ANPE). Après 2008, l’opérateur public se réapproprie l’externalisation pour la mobiliser comme variable d’ajustement, signe de sa position de domination qui confine à un nouveau monopole.
Cet article analyse les objectifs politiques attribués à la fusion de l’indemnisation et du placement des chômeurs survenue en France en 2008. En resituant la création de Pôle emploi dans le temps long des politiques de lutte contre le chômage et sur un espace plus étendu que le seul territoire français, le texte souligne combien les pays de l’Organisation de coopération et de développement économiques (OCDE) partagent une interrogation commune en matière d’emploi : comment articuler les missions d’indemnisation et de placement des chômeurs pour maximiser le retour à l’emploi. La naissance de Pôle emploi est une réponse institutionnelle qui mobilise différents répertoires disponibles, néanmoins combinés de façon nouvelle à l’échelle du cas français. La réforme qui lui a donné naissance repose sur la rationalisation de l’administration et de l’organisation des activités du Service public de l’emploi (SPE) en vue d’approfondir l’activation des demandeurs d’emploi. La création de cette institution redéfinit de ce fait la répartition des pouvoirs entre acteurs du SPE et des fonctions entre les organismes qui le composent.
L’accord national interprofessionnel de janvier 2013 est présenté comme organisant l’échange entre flexibilité pour les entreprises et sécurité pour les salariés. Il prévoit de renchérir les cotisations sur certains CDD, si ce n’est pour désinciter à la flexibilité, au moins pour la taxer. Le secteur de l’intérim a obtenu d’y déroger en contrepartie de la création d’un CDI pour les intérimaires (CDI-I), destiné à sécuriser certains d’entre eux. À rebours du postulat des politiques de sécurisation des parcours professionnels selon lequel, le CDI étant dépassé, il faudrait attacher les droits non plus au contrat mais à la personne, avec le CDI-I l’intérim pose le contrat de travail comme outil privilégié de la sécurisation. L’article porte la focale sur l’élaboration de ce contrat de travail en analysant d’abord la négociation collective dont il est issu et ensuite sur son introduction dans la loi. Après avoir présenté les positions des acteurs, le propos se centre sur les différents paramètres permettant de régir la discontinuité des missions au sein d’un contrat.
L’activité réduite est un dispositif d’indemnisation du chômage qui reconnaît le droit d’exercer une activité professionnelle et d’être indemnisé au cours d’un même mois. L’analyse des règles qui organisent le cumul entre revenu d’activité et allocation entre 1983 et 2014 met en évidence les tensions internes à l’activité réduite et le flou de ses justifications. Parce qu’elle interroge la reconnaissance du chômage comme risque social, le rôle de l’assurance chômage en matière de régulation du marché du travail et les obligations faites aux allocataires, l’activité réduite permet d’éclairer les troubles contemporains du traitement assurantiel du chômage.
En 2008, une nouvelle institution, Pôle emploi, naît de la fusion de l’ANPE et des Assédic pour rendre plus efficaces les politiques d’activation des demandeurs d’emploi. Cette réforme de structure vise à mobiliser l’ensemble des ressources dédiées aux chômeurs d’une manière jugée plus « efficiente », i.e. en les confiant à un seul et même organisme public et en créant un conseiller référent unique chargé du placement et de l’indemnisation du chômeur. Alors que cette réforme institutionnelle repose sur une transformation radicale du travail des agents en contact avec les chômeurs, le contenu du travail est éludé lors de l’élaboration de la réforme. La fusion des métiers se révèle progressivement impossible. L’abandon de cette pierre de touche de la réforme – le métier unique – ne remet pourtant pas en cause l’institution créée. En étudiant la place faite au travail dans l’élaboration et l’application de ce programme institutionnel, cet article montre comment les objectifs sectoriels de politiques d’emploi sont progressivement supplantés par l’objectif d’optimisation gestionnaire des ressources sans remise en cause réciproque des objectifs politiques initiaux.
