Mit einer Reihe jüngerer Urteile hat der EuGH die Fundamente einer einheitlichen Anwendung des Artenschutzrechts nach der Habitatrichtlinie 92 /43 gelegt. Insbesondere seine Feststellungen zum Begriff der Absicht verleihen den einschlägigen Bestimmungen große Wirkung, doch sollte man diese nicht überspannen, indem man sie ungeprüft auf den Vogelschutz überträgt. Weitere Klarstellungen betreffen den Schutz von Fortpflanzungs-und Ruhestätten, die Verpflichtung zu vorbeugenden Schutzmaßnahmen und die Ausnahmen vom Artenschutz. Insbesondere im Licht dieser Rechtsprechung erweisen sich die Vorschläge zur Änderung des Bundesnaturschutzgesetzes nur teilweise als geeignet, Umsetzungsmängel zu beseitigen.
I. EinleitungDas europäische Naturschutzrecht ist vor allem in der habitatrichtlinie 1 und der Vogelschutzrichtlinie 2 niedergelegt . es beruht auf zwei Säulen, dem Gebietsschutz und dem artenschutz . Lange zeit hatte es den anschein, für arten gelte ein "enges Schutzregime", das vor allem die Nutzer der geschützten arten, meist Jäger, aber auch ihre Bekämpfung als Schädlinge angeht . 3 ausgangspunkt für dieses Verständnis war die Vogelschutzrichtlinie, die die absichtliche Beeinträchtigung aller europäischen Vögel untersagt bzw . dafür eine Rechtfertigung verlangt . Selbst dieses enge Schutzregime war und ist durchaus kontrovers . Das zeigt sich insbesondere an den vielen jagdrechtlichen fällen 4 und an den Verfahren wegen umsetzungsmängeln . 5 Brisant 6 wird der europäische artenschutz aber vor allem dadurch, dass der Gerichtshof seine Regelung in der habitatrichtlinie keineswegs eng versteht, sondern vielmehr in einem sehr viel umfassenderen und strengen Sinn . Nachfolgend soll die entwicklung dieser Rechtsprechung nachgezeichnet werden . In ihrem Licht werden elemente der anleitung der Kommission zum artenschutz, 7 des deutschen Gesetzgebungsvorhabens zur Beseitigung von umsetzungsmängeln (im folgenden: BNatschGe) 8 und der jüngeren deutschen Rechtsprechung 9 kritisch gewürdigt .
