Chercheure CEE (Centre d'études de l'emploi) L'accord interprofessionnel du 11 janvier 2008 portant sur la modernisation du marché du travail constitue un accord historique par la variété des thèmes dont il traite : rupture du contrat de travail, gestion prévisionnelle des emplois et des compétences, insertion professionnelle des jeunes, formation professionnelle tout au long de la vie et indemnisation du chômage. Le parti pris de cet article est de chercher à en évaluer le contenu à la lumière des thèses et des propositions qui ont précédé sa négociation. Si l'on veut bien admettre que les débats sur l'avenir du marché du travail s'articulent autour de deux thématiques : la sécurisation des parcours professionnels, d'un côté ; la flexibilisation du rapport de travail, de l'autre, l'accord suscite des réactions contrastées. Sur la sécurisation des parcours, il déçoit car il n'en constitue qu'une première étape, incertaine, renvoyant à une série de négociations à venir. Sur la flexibilisation du rapport de travail, l'accord surprend. Là où on pouvait s'attendre à voir émerger des mesures offrant une plus grande flexibilité dans l'utilisation de la main-d'oeuvre, ce sont principalement des dispositifs de sécurisation juridique qui font leur apparition. Résumé Cet article revient sur les réformes du revenu minimum d’insertion (RMI) pour éclairer le processus de décentralisation de cette prestation depuis sa création en 1988 jusqu’à l’adoption du revenu de solidarité active (RSA) en 2008. Les questions touchant à sa gouvernance ont été l’objet de débats publics, mais rares sont les recherches à les avoir relayées. Il s’agit ici d’explorer ces questions en mobilisant successivement deux forums suscités par les réformes : les débats parlementaires, d’une part, les travaux et rapports publics d’évaluation, d’autre part. Ces forums donnent à voir le caractère problématique des choix institutionnels. Tandis que s’affirmait une priorité donnée à l’insertion professionnelle, c’est au département, échelon territorial dont la compétence était l’action sociale plutôt que l’emploi, qu’a été confiée la gouvernance des politiques d’insertion. Celle-ci demeure problématique, du fait de la faiblesse, accentuée par la crise, des moyens d’action des départements.
L’activité bancaire recouvre une grande variété de métiers liée à l’adoption en 1984 du modèle de la banque universelle et à un processus de concentration économique. Ces éléments expliquent la place conséquente dévolue à la fonction ressources humaines (RH) pour tenter d’homogénéiser les pratiques de recrutement de groupes bancaires devenus pour beaucoup des « mastodontes ». Ces recrutements relèvent en réalité de deux marchés du travail bien distincts : un marché du travail à dominante interne pour la banque de détail et un marché du travail à dominante professionnelle pour les banques de financement et les banques d’affaires. Ces deux modèles mettent au jour des formes de gouvernance spécifiques qui mobilisent différemment les managers et les professionnels RH dans l’organisation et l’acte même de recrutement.
Cet article interroge les voies possibles d’un renouvellement de l’action collective face à un certain nombre de mutations qui affectent le monde du travail : la place du digital, l’essor des plateformes numériques, le développement de nouvelles formes de travail indépendant. Au terme de notre enquête de terrain, nous avons identifié quatre configurations susceptibles d’éclairer ces nouveaux enjeux syndicaux associés aux transformations de l’emploi et du travail. Dans tous les cas, il existe du « grain à moudre », qu’il s’agisse des thèmes traditionnels de la revendication collective (rémunération, temps de travail, santé), ou des questions de protection et d’autonomie, telles qu’elles sont posées par les nouvelles formes de travail et d’emploi. En outre, de nouveaux acteurs collectifs ont émergé, avec lesquels les organisations syndicales tentent – ou non – de travailler à la « mouture » de nouveaux droits.
