La Unión Europea tiene cerca de quinientos millones de consumidores potenciales. Y aunque los Estados miembros han ido implementando medidas dirigidas a defender los intereses de los consumidores desde mediados de los años setenta, la UE no ha dejado de promover y armonizar medidas para garantizar a los ciudadanos europeos un elevado nivel de protección en el mercado único europeo. Aspectos claves en los contratos con consumidores como lo son el derecho a una información clara y comprensible sobre el producto o servicio antes de la celebración del contrato, el derecho de desistimiento, la conformidad, las garantías o la protección frente a las cláusulas abusivas son objeto de este trabajo. Las recientes Directivas y Reglamentos sobre los mercados en línea o los contratos de suministro de contenidos y servicios digitales, no han hecho sino poner en valor la relevancia de conocer estos derechos y analizar muchos de los avances dados desde Europa. En este punto, el objetivo de la Unión es proporcionar a los consumidores igual tutela a los contratos on–line que a los celebrados off–line. Y aunque quedan al margen de este estudio tanto el Reglamento 2022/1925 (DMA) como el Reglamento 2022/2065 (DSA), sobre mercados y servicios digitales, respectivamente, especialmente plataformas en línea, muchos de los derechos incluidos en este estudio serán punto de referencia en los nuevos entornos digitales.
