A dissonância do quadro institucional brasileiro na Rio+20. o caso do clima e do código florestal * Brazil's institutional dissonance and its challenges for the Rio+20 conference ResumoO objetivo deste artigo é analisar a coerência entre a política externa e a política doméstica brasileira em relação a temas de interesse para a Conferência das Nações Unidas sobre Desenvolvimento Sustentável realizada em AbstractThe first aim of this article is to assess how compatible Brazilian foreign policy and domestic policy related to sustainable development issues are at the very moment the Rio Conference took place. Trachtman, Keohane & Victor, and Hathaway were part of the theoretical framework to analyze two intertwined cases: climate change and the reform of the forest code. The main conclusion is that Brazil is experimenting a period of institutional fragility, notably due to the dissonance between the Legislative and the Executive powers concerning the easy adherence to multilateral environmental agreements and their difficult process to enact the legal rule as a national measure, and finally comply with them. As a consequence, the Brazilian international obligations are not necessarily followed by domestic measures, jeopardizing Brazil's capacity to honor its international commitments. The originality of this text consists of its interdisciplinary approach between law and international politics considering states and subnational actors.
As mudanças climáticas são o maior desafio a ser enfrentado pela Humanidade neste século XXI. A extensão, a gravidade e a urgência do fenômeno estão a demandar da comunidade internacional solução imediata e eficaz. O Brasil tem participado ativamente das negociações do regime internacional sobre o tema, em várias esferas. Uma delas é o Diálogo G8+5 sobre Mudança do Clima, promovido pela Globe International. Entre 2006 e 2008, a entidade realizou cinco Fóruns de Legisladores, que produziram relatórios e recomendações políticas aos líderes do G8. O propósito desta monografia é comparar as conclusões desses trabalhos com a posição oficial defendida pelo Brasil nas negociações formais nas Nações Unidas.
