Los medicamentos biosimilares vienen siendo comercializados en el territorio regulatorio europeo desde hace trece años. Su comercialización no ha estado exenta de múltiples críticas, especialmente las confusiones en torno a su errónea equiparación con los medicamentos genéricos y las dudas generadas en cuanto a su posibilidad de intercambiabilidad y sustitución. En este trabajo exponemos que, gracias al desarrollo de los medicamentos biosimilares, se introduce competencia en el mercado farmacéutico y se fomenta la innovación en el sector sanitario. Además, dado que los medicamentos biosimilares se distribuyen a unos precios más económicos con respecto a los medicamentos biológicos originales, también facilitan la accesibilidad de los tratamientos a los pacientes y contribuyen a la sostenibilidad de los sistemas sanitarios públicos.
El presente artículo recapacita sobre las reformas normativas acontecidas en las últimas décadas respecto al uso racional de los medicamentos, y las medidas operadas en torno a la disminución del gasto farmacéutico. En este contexto, debe destacarse el elevado coste de las terapias biológicas y las dificultades de acceso a las mismas —especialmente en los países en vías de desarrollo—. Los medicamentos biosimilares son poseedores de garantías sanitarias análogas —semejantes o equivalentes— a los medicamentos de referencia, pero no están sometidos a una protección por una patente y facilitan la accesibilidad a los pacientes, así como al reparto equitativo de los recursos terapéuticos. Además, algunos de ellos están incluido en la lista de medicamentos esenciales de la Organización Mundial de la Salud (OMS).Asimismo, se examina el papel de los medicamentos biosimilares como esenciales y la posibilidad de mejorar el acceso equitativo a estos recursos sanitarios a través de la prestación farmacéutica.

This issue has caused a significant change in the aim's view of the origin and development of counterfeit medicines and its relationship with the Spanish legal system in accordance with EU and international law.Efficacy, quality and safety of medicines depend on several elements present in traceability or in their life, such as research and development of an active ingredient or appropriate pharmaceutical agent, manufacturing, quality control, distribution, testing requirements, reliable information for health professionals, diagnosis, prescription, medicine dispensation, treatment compliance and pharmacovigilance. At each level, conflicts of interests among the groups involved arise, and in many occasions, the patient pays the consequences of these divergences. This is the case of counterfeit medicine, since it is a product deliberately and fraudulently mislabeled with respect to its identity or its source. Counterfeiting can be made in both branded and generic medicines, with the correct ingredients or with the wrong ingredients, without active ingredients, with insufficient or too much active ingredient, or with fake packaging.Counterfeiting practice is a major cause of morbidity and mortality in both developing and developed countries. In the present work we analyse this problem and how effective solutions have been developed to try solving such proliferation both at European and international level.
Introducción: Ni el legislador, ni los diferentes estudios previos han establecido una clasificación exhaustiva de los medicamentos de elaboración o preparación no industrial en el territorio regulatorio español. Métodos: Revisión bibliográfica sobre la normativa (nacional y comunitaria) y estudios doctrinales relativos al marco jurídico de los medicamentos de uso humano, y el análisis de la misma. Resultados: En la literatura no se encuentra una clasificación adecuada de los medicamentos de elaboración o preparación no industrial. Conclusiones: Se ha propuesto una clasificación doctrinal de los medicamentos de elaboración o preparación no industrial basada en cuatro categorías principales.
