El presente artículo se desarrolla con el objetivo de analizar las campañas negativas emitidas por los medios de comunicación y su incidencia en la vulneración del principio de inocencia dentro del sistema procesal penal ecuatoriano, afectando de esta manera la imparcialidad decisoria de los jueces. Para lo cual se utilizó un tipo de estudio descriptivo con la finalidad de describir las características y naturaleza que, mediante el derecho a la libertad de expresión e información, tienen los medios de comunicación para cubrir las noticias de carácter criminal y como esto influye en las decisiones judiciales dentro de los procesos penales. Obteniendo como resultado que, la función judicial en ciertas ocasiones se ve afectada por la opinión pública, derivada de una información que a veces resulta distorsionada o incluso maximizada en su naturaleza criminal, lo que influye de manera negativa en las peticiones propuestas por la fiscalía y las decisiones de los jueces, sobre las penas que deban aplicarse a los procesados por el cometimiento de un delito, el cual puede no siempre ser meritorio de las penas máximas que la Ley exige, aplicando los principios de proporcionalidad y racionalidad. Por lo que, se concluye que los jueces y fiscales participantes de un proceso judicial en el que se encuentren involucrados los medios de comunicación deben mantener un alto nivel de profesionalismo, evitando verse comprometidos por las presiones tanto mediáticas como sociales para poder tomar las mejores decisiones en virtud de promover la justicia.
