Purpose -Draws attention to recent broad trends in UK employment regulation that refocus the emphasis in employment rights away from a primary concern with safeguarding collective rights toward a more differentiated approach privileging more individual concerns. Design/methodology/approach -Seeks to explain the reasons and consequences of this development.Findings -Argues that rights are defended on the basis of their ability to secure greater employee motivation and productivity. Practical implications -Explains that this is a business-case defence rather than a requirement for social justice. Social implications -Advances the view that modern Conservatives see society as made up of a broad range of actors and not reducible to state action.Originality/value -Claims that the extension of the minimum period of employment required before an employer may be taken to tribunal to two years, together with a greatly increased fee required to bring a case, mean that cases are much more difficult to make.

Both are vastly different and separated by walls of racism and racialism which have become toughened and almost insurmountable with age.The first, a white world, protected and isolated by beautiful murals of democracy, fair-play, freedom, equality, meritocracy and faded images of the glories of the Empire. Pictures so vivid and life-like that they deceive. The other, a spectrum of colours from coffee to black -not painted on walls but on skins. On this side the walls are invisible to the eye, yet stronger than iron.No longer are there signs that say 'No coloureds here' or 'Coloureds need not apply' to enter our world, yet they exclude as effectively as ever. With time and practice has come a greater efficiency and sophistication. On this side the First World's beautiful pictures of freedom, fair-play, democracy, equality and meritocracy can be clearly seen. At first their vividness and beauty attract and deceive, but time, age and experience expose them to be false ... of no greater substance than paintings on a wall. In this SecondWorld we learn what it means to be second-class and second-rate. This was determined at birth, by the colour of our skin. Migration from the Second to the First World is extremely restricted and is only ever on condition of good behaviour.
