Jason Brennan, who proposes assessing democratic decisions based on non-procedural expert knowledge from a pure utilitarian standpoint, holds a prominent position among libertarian critiques of democracy. Brennan contends that epistocratic regimes can outperform democracies since democracies perform badly due to the phenomena of rational ignorance and deliberative democratic methods cannot solve this problem. Brennan, who compares epistocratic institutions to constitutional institutions, wants to tame democracies using negative externality arguments. In this study, we demonstrate that constitutional democracies cannot be assessed by the Brennanian metrics and that epistocracy will erode the libertarian political successes of constitutional democracy. Two important arguments back up this conclusion. First, transforming libertarian ideals beyond constitutional rules into the standard for daily politics allows experts tremendous discretion. Even with good intentions, the unchecked discretion of experts would most likely undermine the general, abstract, and egalitarian rules required by a complex society. Second, taking the concept of rational choice out of its original context will make the distinction between constitutional and unconstitutional governments unclear. Therefore, the libertarian ideal of the limited government established by the separation of powers and the procedures of checks and balances would lose its significance, giving place to the unchecked discretion of expert rule.
ÖzetYeni kurumsal siyaset, kurumsal siyaset yaklaşımını yeniden siyaset biliminin merkezine almayı hedefleyen disiplinler arası bir akımdır. Eski kurumsal siyaset yaklaşımının kullandığı formel-yasal analizin sınırlılıklarının, 1950'lerden itibaren davranışsalcı, rasyonel tercihçi ve neo-Marksist yaklaşımlar tarafından yoğun bir şekilde eleştirilmesinin ardından, devlet, bağımsız bir değişken olarak siyasal çalışmaların merkezinden uzaklaştırılmıştır. Bu gelişmeye tepki olarak doğan yeni kurumsal siyaset çalışmaları, eski kurumsalcılığın formelyasal analizinin sınırlarını aşan yeni bir kurum tanımı ve anlayışını 1980'lerden itibaren geliştirmektedirler. Siyasal kurumların doğuşu, değişimi ve siyasal kurumlar ile failler arasındaki ilişkiler, formel olduğu kadar informel kurallara ve konvansiyonlara dayanılarak, yasal olduğu kadar kültürel faktörlere dikkat çekerek yeniden teorileştirilmektedir. Bu akım içinde ekonomi, sosyoloji ve tarih disiplinlerinin yöntem ve bulgularından geniş bir şekilde yararlanılmaktadır. Bu nedenle bu çalışmada, yeni kurumsal siyasetin üç farklı ekolü olan, rasyonel tercih, sosyolojik ve tarihsel yeni kurumsal siyaset ayrı ayrı ele alınarak, söz konusu farklı ekoller arasındaki çatışma ve kesişmeler üzerine tartışma yapılacaktır.
Klasik liberalizm geleneğinde en istikrarlı ve bütüncül anayasal reform talebi kamu tercihi teorisyenleri tarafından yapılmaktadır. Özellikle Amerikalı yazarlar mevcut konvansiyonel kuvvetler ayrılığı ve denge-denetleme kurumlarının bireylerin birbirleri üzerinde negatif dışsallık yaratma imkanlarını yeterince sınırlandıramadığını ve liberal demokrasilerin rant kollayan toplumlara doğru hızla ilerlediğini ileri sürmektedirler. Bu bağlamda yazarlar anayasaların epistemik ahlaki önermelerle demokratik prosedürlerin sert bir şekilde kısıtlanmasını teklif etmektedirler. Bu çalışmada Hayekyen bilgi ve sosyal teori bağlamında dışsal sınırlamaların neden anayasalar için gerekli olan liberal ilkeleri koruyamayacağı açıklanmaktadır. Dışsal sınırlamalar yerine Hayek’in iki kamaralı meclis teklifinin liberal ilkelerin keşfi için neden daha önemli bir anayasal tadilat teklifi olduğu tartışılacaktır.
It is claimed in this article that one of the main aims of the "bureaucratic tutelage" system in Turkey is to control the distribution of the economic rents created by the import -substituting industrialization. Thus, economic statism and the bureaucratic control over elected politicians were compatible with each other until economic liberalization in 1980. E ven a limit ed economic liberalization created great opportunities for the politicians to weaken the power of the bureaucratic elites, particularly military officers. Thus, there is a strong relationship between economic liberalization and democ ratization in Turkey after 1980. However, even though, bureaucratic tutelage is regressed, Turk ey is still far from having a transparent government and efficient public organizations. The conventional explanations are not adequate to grasp the intermingled relations between economic and political institutionalization in Turkey. Therefore, public choice may help to understand the role of the economic motivations of the political actors/elites in the context of shaping the political institutions. The political actors are seen as utility maximizers within the limits of institutional rules and practices, and the institutional change is explained with the help of changing interests and power relations of these actors. Enlarging economic liberties have gradually forc ed bureaucratic tutelage system to dissolve. For sure, dissolving the bureaucratic tutelage system is not a perfect or an intended process but examining this process from Turgut Ozal to Tayyip Erdogan gives us a theoretical framework to understand the political transformation of Turkey in the era of an open economy.
