El trabajo examina las principales teorías que se han formulado para legitimar los delitos de peligro abstracto; esto es, la criminalización de comportamientos que, en general, crean un riesgo para bienes indeterminados, aunque pueden presentarse circunstancias particulares en las que una conducta de esa clase no ocasione tal peligro. Luego de analizar críticamente diferentes propuestas de legitimación, se defiende la perspectiva que concibe a dichos delitos como presunciones rebatibles. Si bien este enfoque ha sido defendido con anterioridad, el trabajo presenta argumentos que permiten comprender más acabadamente sus virtudes como también responder a las objeciones que se plantean en su contra. Concretamente, se argumenta que la concepción de los delitos de peligro abstracto como presunciones rebatibles puede maximizar los beneficios de recurrir a esta técnica legislativa, ya que aprovecha en buena medida las ventajas que otorgan las reglas, sin incrementar sustancialmente las situaciones de injusticia material.
Resumen El trabajo argumenta que resulta legítimo castigar a los funcionarios públicos por aceptar regalos en el ejercicio de sus funciones, y a los particulares por ofrecérselos; esto es, cuando la dádiva es otorgada por mera consideración al cargo, pero no involucra un compromiso por parte del funcionario de realizar cierto acto como contraprestación –quid pro quo–. Concretamente, se sostiene que por la función expresiva que desempeñan los regalos, en la medida en que favorecen el surgimiento de relaciones estrechas entre los agentes, los regalos tienen la capacidad de interferir en las decisiones de los funcionarios y, de este modo, pueden afectar el normal funcionamiento de la Administración pública. Asimismo, a partir de ciertas herramientas desarrolladas por la teoría del delito, el trabajo propone pautas para determinar en qué casos la aceptación y el ofrecimiento de regalos deben considerarse atípicos. Por último, se plantea una serie de parámetros que pueden ser útiles en la práctica para distinguir la aceptación y el ofrecimiento de regalos de los sobornos.
El trabajo analiza la perspectiva que promueve la despenalización de la conducta de ofrecer sobornos –cohecho activo- como un modo de disuadir la aceptación de sobornos por parte de funcionarios públicos –cohecho pasivo-. En líneas generales, esta propuesta se apoya en el argumento de que, si el cohecho activo no constituyera un delito, ante el temor a ser denunciados por los sobornadores, desde el principio, los funcionarios se abstendrían de solicitar o aceptar el pago de sobornos. Luego de examinar diferentes estudios teóricos y empíricos sobre el problema, se argumenta que, si bien en algunos casos la despenalización del cohecho activo resulta conveniente, en otros, hay razones para suponer que sería una medida contraproducente, pues daría lugar a un incremento tanto del ofrecimiento como de la aceptación de sobornos.
