A dinâmica imobiliária decorrente da produção capitalista do espaço exprime, dentre outros aspectos, um cenário de insegurança habitacional frente à moradia de aluguel, que ainda tem pouco amparo de políticas públicas setoriais positivadas em lei, acarretando em um acirramento da lógica de segregação socioespacial. Nesse sentido, a atuação do Poder Judiciário tem tido papel decisivo na produção e reprodução da seletividade no espaço urbano a partir do processamento e expedição de mandados de despejo, fato este agravado nos períodos de crise, como a vivida em virtude da pandemia de Covid-19. Diante do turvo horizonte pandêmico, o norteamento normativo de locações em países como EUA, França, Espanha, entre outros, foi deslocado para uma adequação a novas regras, com vistas a evitar os despejos. No Brasil, o enfrentamento da questão se deu por meio da Lei 14.010/20. Esta pesquisa objetivou observar como o judiciário de São Paulo, nos fóruns cíveis da capital paulista, acolheu a Lei 14.010/20 durante seu período de vigência, mencionando-a nas decisões das sentenças de execução de despejo, referentes a imóveis residenciais, bem como utilizando-a como instrumento de suspensão das liminares de despejo no período. Foram catalogadas 114 decisões, referentes a imóveis residenciais, proferidas por 55 juízes da capital paulista. Dentre elas, apenas 17 (14,9%) mencionaram a lei 14.010/20, enquanto 19 decisões (16,66%) citam a pandemia. Apesar das citações, apenas 4 decisões (3,5% do total), proferidas por três juízes (5,45%), suspenderam despejos até a data de vencimento da referida lei, demonstrando sua baixa expressividade no escopo dos despejos como um todo, trazendo ao debate a necessidade de implementação de outros instrumentos de maior eficácia na prevenção de despejos, com vistas às garantias dos direitos fundamentais à vida, à saúde e à moradia durante a pandemia.
